i just sold a high $ item and requested that it be sent as a gift, as to avoid fee's.

can the sender w/d that $ somehow and i take a loss?

not unless he call he cc company and denies he made the transaction. If you were the buyer and sent it as a gift, I would be more worried, then being the seller

You should price items to account for the charge from PayPal so that you dont have to ask people to do that. By asking them to do that you are asking them to violate the terms and conditions of use that they agreed to when signing up for PayPal.

That being said people do it all the time.

when buyer does that they forfeit buyer protection, it is great for seller as they avoid fees but the buyer not so much...

Buyer is still able to cry "fowl" when payment is made via gift.

I had a guy do this to me recently when he wanted to buy something that I had on Ebay and offered to pay as "gift" in order to entice me to do the deal. I did the deal. A week following receipt of item he claimed item was not as expected (he had wanted me to make him a "killer" deal on a bunch of other stuff, and I would not). This caused a full review of transaction on item. Fortunately, I had done the deal after the item closed on Ebay, so no issue there. Mediator ruled in my favor, so all eneded well.

Even when paying as gift, Buyer can still claim "foul". And as you have Paypal linked to a bank account, they retain a way to credit the Buyer if ruled in their favor.
