What police report did they make? An accident report? They can easily fight it as well since no vehicle to vehicle contact was made. A good lawyer can turn it around on you. You were hauling and they were trying to leave the parking lot or whatever they were doing.
Tis true!

Sorry you went down. I didn't actually witness the accident so I won't bother to offer you more awesome advice.

Hold on Matlock, first of all read it again. 1.) no one was leaving out of a parking lot 2.) Speed limit on 1960 in that area is 50mph 3.) the police report/accident report call it the TMZ report which is in my hand and on my lawyers desk faults the car not the bike.

Its amazing how we can watch a few episodes of law and order and now we are all dime store lawyers....the point of the story was not to illicit responses on what you think the legal ramifications might be, it was to simply say, stay alert...but I appreciate the knowledge MATLOCK

I had to go to court even with my accident report saying the other person was at fault. Just giving you a heads up!

I think I'm qualified to give my opinion. Doesn't matter if you go the speed limit. You still failed to control that speed you were going.

....yes like this was a perfect example of how you can do everything right and not avoid an accident/injury. :-)

We learn so much more from, "aww" and "diddums get a booboo" comments then trying to get accurate information and analyze the accident.

Yes, definitely do it. I went down on the 2nd and cut my knee up pretty bad too. I was too stupid to go to the hospital that day, so no stitches, but it was pretty deep and nasty. I sprained my pinky, scraped the bottom of my palm and got the knee pretty banged up. The palm and pinky don't bother me much at all. That wouldn't have changed much at all. It's the knee that's killing me. So just from experience, I will say that knee pads are totally worth it. And don't til next paycheck like I was doing, do it no. I never made a separate thread about the wreck (maybe I will) but if you look in the events section, the thread on forest ride 5/02 somewhere in the last few pages there should be a few pics in there of everything.

To the OP: Glad you're ok man. Hope you have a speedy recovery and can get back up soon.

My brother had a truck pullout in front of him , he low sided , and because there was no contact between the two it wasnt the other guys fault . Hire a lawyer if they screw you around , especially since you have witnesses

geez bro. hope you recover quick. I did 1960 for a year from 45 to 290. I didn't realize till just recently how lucky I was as a new rider to not have a wreck riding that road during rush hour everday. I'll take the beltway anyday now.

not knowing anything about you. i think you might have panicked and GRABBED the brake instead of SQUEEZE the brake. I have done the same thing when a dog ran in the road at night, didn't flip over the front but came close to it. I think the back wheel came up but i can't remember. Well your still alive to ride again. good luck with your recovery and pain meds. lol.
