If a bike owner shot a thief...?

...for trying to steal his bike, what would be your response?

If he tried to steal it out of his garage?
Or just tried to steal it out of his driveway?
Or just out of a random parking lot?

NOT breaking into their house, nor threatening them or their family's life.

What would you do?

I still can't think of a hypothetical situation where you would point a gun at someone trying to steal your bike and they would just continue on with the theft.

The situation isn't dependent on what he does "after" he is on your property trying to steal what belongs to you and sees you. It's what would YOU do when said thief was on your property stealing FROM you?

If this were the case, would he really even have to be stealing anything?

If on your property you're more likely to come out of court without persecution. If in a parkinglot without a CHL nor having your life in grave danger I'd wish you luck in court and keep them cheeks clenched tight.

Dont kill him until you get information about a lifted busa the fkr took a month ago.

Then still dont kill him; human life is precious. Cut off his hands so he is reminded in everything he attempts to do in life there on out he belittled himself to bring misery on others for his own meager benefit.

i would like to think that i would have enough restraint to NOT shoot , but still it would me off , but i would not want to take a life for that ,

i hope that in my life i never have to kill anyone but if i do i would expect it to be a defensive act, !

that is just me !

Actually, the state of Texas is very clear on what constitutes the use of deadly force. If you are in the state of Texas and someone is attempting to break into your car or is in the process of attempting to steal your bike, by law you can use deadly force regardless of where your vehicle happens to be (again, as long as you are in Texas). Texas's "castle doctrine" laws cover your home as well as your vehicle.

With that said, the only way I would ever shoot someone is if I feared for my life or the safety of my loved one's. Would I cap a guy in the back as he was driving off on my bike? Nope, I couldn't live with that on my conscience. However, if I ever felt that an intruder meant harm to me or my family (like if they broken into my garage in the middle of the night) - he would be dead in a hearbeat, no hesitation whatsoever.

one point to make also " at night" you see that all the time , the crime if done at night falls under diff actions, things are diff at night and yes if some one is breaking in to my home , that automaticly put me in a fear of life or loved ones, you will get shot if you are breaking in to my home at night ! or any other time of day ! but as far as objects, no !

I was actually having this debate earlier tonight without having seen this thread before. I had some drunk D-bags try to roll my bike out from under my porch last night. (I live in a student community apartment complex) And I was trying to come up with reasoning to be justified in shooting someone for attempting to steal mine.

Chances are, like someone else said, if you brandish a gun I would think just about anybody would stop. But after that point, if you're stealing from me, you'd get pistol whipped to the ground so I could call the cops and have you arrested. I can only hope I wouldn't have to shoot someone for stealing my bike. But when you can't respect someone's personal property, why should I have respect for you?

Depends, if its in my garage, they're already dead. If its on my patio they're already dead, if its in a parking lot They're their pants and the cops are being called.

I have no problem capping someone riding off with my bike. or my shoes, for that matter. some lessons should be learned, and one less thief is a good thing.
