If the state drops it then HPD cannot enforce it unless it violates a city ordnance.
Those are old offense titles anyway. You can still be cited under Sec. 545.420 of the transportation code. "Racing on Highway"

A person may not participate in any manner in:
1. a race
2. a vehicle speed competition or contest
3. a drag race or acceleration contest.........

There's more but that's the beginning of the code.

Oh, this applies to two or more vehicles and also one vehicle.
...one or more vehicles over a common selected course, from the same place to the same place, for the purpose of comparing the relative speeds or power of acceleration of the vehicle or vehicles in a specified distance or time.

Ultimately it boils down to what the district attorney's office will accept.

Seems as though if you're alone, you're not comparing recorded time or speed, and you don't break the speed limit, you may accelerate as quickly as you wish, no?

I may be wrong but some of this stuff with regards to acceleration/wheelies and racing have been reclassified as "Reckless Endangerment" which is a JAILABLE OFFENSE and can be a FELONY.
That may be why they dropped the old classification.

It's not called reckless endangerment here in Texas. Maybe in California.. It's plain old reckless driving. It's a misdemeanor, not a felony.

Yup. No more exhibition of speed. I once got a ticket for exhibition and have since been arrested for reckless. Funny thing is that my "exhibition" was far more dangerous than the reckless. Just depends on the cop.

What's brutal is as soon as I pulled ou onto the road and stopped at a light roughly 8 cars and bikes surrounded me, some with their guns unbuckled or whatever(not drawn that I saw) Can't remember if it was a class C or B. I wanted to messwith them so I pled not guilty, and they offered deferred. I knew I wasn't gonna get my arrest record gone, so I took it since I wasn't gonna be fined, and my probation they said was 'already up' Now I have an arrest record for a $160 ticket it a wet parking lot.

Got pulled by a Galveston County Sherriff this past weekend for a deserved ticket, and he was laughing about it when I explained what happened. Sherriff was a stand up guy though. He was one that whenever you get pulled over, you hope it's by someone like him. I still got the ticket, but he told me how to get it reduced, and was all around very respectable.
