what would you do?

So I has been looking for a corbin seat for my f4i. Saw one on ebay with the buy it now price @ $165. It had the 'or best offer option' and I offered $160 and the guy rejected it. Then he contacted me later on offered to sell the seat outside of ebay for $160. I shouldn't take it but I did. Paypaled the guy $180 ($20 for shipping) and he sent me a USPS tracking number.

Well it was two weeks ago and now the tracking number showed that it was delivered but I never got it. I called the USPS but they don't have it. They told me to call back tomorrow and talked to my carrier to see if the guy remembered the package. I already sent the seller an email telling him that I never got the seat and he needs to refund my $ but he hasn't responsed to my request. He charged me $20 and shipped it parcel without any insurance so if I can't find it then it's SOL.

So is it my fault or the guy should refund my $? What do you guys think?

If you payed with a credit card through PayPal then you can file a chargeback. Otherwise, your pretty much SOL. Buying anything outside of eBay voids a lot of buyer protections you would have to get your money back. Ultimately, it is the sellers responsibility to get the package to you. It is also the sellers responsibility to insure the package against theft or lose to cover THEIR . I hope that you can recover your money one way or another.

If that package was delivered to your address and you did not stipulate that you wanted it signed for then you are sol. It is not the sellers responsibility to insure your package from his pocket, that option is yours. If the seller put the wrong addresss on it then you could have a problem proving it unless it was signed for. One of our local postal carriers decided she was going to start stealing packages and not get caught. What a dumbass idea that was...especially having them at ther house.

Sorry, but that's your bad. Why should he pay because the USPS lost the package, especially if you guys didn't specifically discuss insurance on the package. I always ask if the buyer wants insurance, and only purchase it when they pay for it. His responsibility ends when the package leaves his hands in good condition as described in the listing - with or without insurance.

Also, you're sol as far as getting paypal to charge back. He's got a tracking number and it shows the package delivered. If it's signed for then you lose. You only have a case if it isn't signed for (and maybe not even then).

On another note, I'd be willing to bet he's having a similar discussion with his friends....he probably thinks you're scamming him. I know I would. Tracking shows delivered, but the guy says he didn't get it, huh? Yeah right.

Ps. I ran an online website for quite a while and had issues with this kind of stuff all the time. It's actually quite common for packages to get lost or misplaced by the USPS. Just my .02.

the package did not require a signature so nobody signed 4 it. I should have gone thru ebay but i didnt. The auction ended then he offered 2 sell it c 2

Not the sellers issue if he actually shipped it and gave you valid tracking info. Did UPS verify the correct delivery address as yours? Aren't all UPS deliveries insured for at least $100? You will need to work with the seller on any claim, since the shipper's commitment/insurance is to him. Don't him off with threats and such if you want cooperation. If you think it was fraud then report it.

sounds like you are SOL. if you shipped a $160 item to someone and they said they never got it, but the tracking # said they did, would you refund them? no. find out who signed for it, and go from there.

I had the same thing happen. It was a camera mount that my neighbor got instead of me. They held onto it for 2 weeks then sent it back to USPS. I was kinda frustrated at the fact they didn't just walk over to my house and ring the door bell, they were always going in and out of their house so it's not like they weren't home.

So I went around my neighbors and asking whether they received any strange package and guess what. It was two door down. Got my corbin seat, yes!!!!! F*cking postal workers.... Now I have to eat crow and apologize to the seller but I got my seat. It felt awesome.

Of course I talked to them. The package was inside their house. I just said thank you and took the package. They know I live in the address on the package but they don't know my name. Guessed they too lazy to knock on my door. All is well tho cuz I love the corbin seat.
