it also didnt appear that he was actively attempting to sell anything when he created that thread, someone asked him if he freelanced and he responded.

ok i just added up all the figures and heres what i come up with:

all of the barbeques ive had in the past--this includes the food, paper plates, plastic ware, any beer i bought and admission onto my property-tallies up to aproximately $1400. minus the 25 bux i owe ryan, that leaves $1375 to divide up between the two of you.

be expecting a certified letter within the next couple of days.

Simply because you took a photo of a person does not mean that it can be used for commercial purposes.

To the OP: If you want photography for a commercial website then pay for it. You don't work for free, why should photographers?

Please make sure that you understand usage rights, copyright and model releases before using photos or giving photos away especially for commercial use!

Good point mike. I don't know the full ins and outs on usage of photography for commercial purposes, but won't the OP also need everyone in the picture to sign off allowing him to put them on his site?

whoa the voice of reason? The man speaks the truth. He speaks LAW which is what this country is based upon and not based on posts on motohouston contrary to popular belief.

Anyone who wants to give a way pictures must know that the person in the picture or businesses, logos etc can't be used. UNLESS you get signed written permission from that person giving away all rights to that picture. Of course if you doing something in a public place then you lose those rights. (paparazzi business model).

I almost always get a model release from someone I take pictures of unless they want to pay me extra to buy the rights to the pictures. Here is an example of a release.

model release

Just in case anyone is wondering why someone would go through all that trouble think about the papparazzi. Each picture they take they get paid for every magazine/website that wants to publish it. Most of them are self employed and draw 100% of their income from photography. Usually they invest 100,000$ or more in equipment, cars, gasoline their time etc as a risk so there should be a payoff. Recently Perez Hilton lost a $7.1 million lawsuit because he was stealing pictures and drawing pictures of penises on them and not paying the people who took the picture.
