i also told the kid to tell his dad when he got home to call me thinking he would know i'm serious if i drove all the way to his house at 9:30, still no phone call, i also tried again today to get in touch with him and no answer. how am i going to get into his garage with the officer if noone is home at the time?

If you put a case against them(heaven forbid it comes to that) you can have them served and let it be someone else's problem to contact them.

that's the advise i got from some other folks, take the bike straight to yamaha or shop of my choice and get them to write up and estimate. Then, send this estimate in a certified letter to this guy in an attempt to get him to pay the bill, if he still doesn't respond, take his a$$ to court and they can make him pay. if he still doesn't do that, i'll sit down the road from his house and wait till they start smoking the funny stuff and then call lojack and report it stolen, i'll bet he really likes me then

Its a messed up situation... really... I cant think of any legal experts on here but there are some cops you might be able to ask about their potential part in trying to confront the father. Obviously they are avoiding you.

yep, i also just thought about calling my insurance and seeing what they pay for as far as theft and if theyll cover the damages then i'll just call lojack and report it stolen and let the insurance deal with paying the bill and homey can spend some time in jail and think about what he's done.

yet another day with no word from either of them, can't wait too get this ball rolling. might go either tomorrow or thursday or maybe even friday to pick up the bike and take it to texas yamaha. can't wait to see the repair bill any guesses?

dude, this is the first I have heard about any of this... Not sure what the story with all this is but....I just know, don't report it stolen until you KNOW you can't get it back because if they can prove you let them take it to do whatever....(ie. phone records, witnesses etc) then you can have charges filed against you for filing a false claim(theft).

You need to talk to a lawyer about all of this. Not sure what grounds you have if there is no paper trail but..... I would definetly call Tejas, whether they did the repair or their employee did it on the side, they will put pressure on him about it. I would find out which employee did the work and go after him..

Sux...... I am guessing you were trying to sell the bike a potential buyer wrecked it, then had a "friend" that could repair it for cheap? Deals like that NEVER come out good.....

u got it bro, long story short, i let him test ride it, he wrecked it, took it to tejas to get the oil pan fixed. i went over to check it out, the fairings are still busted, still a dent in the gas tank, oil pan still dripping and cracked after being "repaired" at/by tejas, and chunk of the block where one of the oil pans bolts goes into missing and the bolt is cross threaded into the block. and now here i am, haven't heard from the guy in two weeks with a busted a$$ bike and not quite sure what to do.

dude.....I don't know what to do about that.....legally speaking, if there was no paper signed on anything, not sure what recourse you have....You COULD take the to small claims court but you would have to "prove" he was the one that rode/wrecked it..... even so, you probably wouldn't get much, especially after you pay the court fees etc.... I would talk to a lawyer. I will PM you my lawyer name and number.

Wow hate to say it but get ur bike back already, a month is too long. If its not already fixed, they are not gonna fix it! Talk to an attorney and find out what ur next step is. I would guess it would be: to get an estimate, and file a lawsuit against the kid or his family, maybe they can claim it on their insurance as a quick way (if they have it) or they can be forced into restitution via the courts to cover the expenses.
Bad part this could take a very long time! The only way to get things moving though is to threaten with a lawsuit.
Sometimes just hiring an attorney to send a threatening lawsuit letter may get the ball moving. As for Tejas, i dont think u have any recourse there, unless u can prove work was done there. Seems like this one is personal. This guy may not even told his dad what happened. May want to make sure he knows the siuation and let him know what ur next legal move is should he decline to reimburse you. Also how hold is the kid that wrecked ur bike? Adult? If so no need to talk to daddy...u already know who the judgment will need to go against. I beieve there is a guy who posted for an inspection sticker this past friday who works for tejas (cant remember his name) he maybe be abe to help too.

I would definately call the owner of Tejas and let them know what kinda of tty deal has been done. Take the bike up there and raise , if they dont want to fix it the way it should be. Let them kow you will be filing a report on them and spread the word how tty they as a company are.

yeah, i'm going to call channelview pd today and see if they can send an officer out so i can pick it up. only prob is i dont have any ramps and my truck is pretty big. i also don't have anybody to go out there with me to help load the bike.
