Usually you can refuse to blow, but then they will more than likely take you down to the station for a blood test.
So If I get pulled over for a broken tail light they can ask me to take a breathilizer test?

I'd refuse.

and from my understanding you would get taken to the station in the back of the cruiser for blood work and if any traces of alcohol were found you would be booked..........i am no lawyer or cop, so i MAY be wrong. that is just what i believe to be the way this works........any 5.0's want to clarify?

And to answer your question Moody, yes I have heard of this. I think its a good thing.

I have been hit by two drunk drivers with no insurance and totaled both trucks. I have also watched a drunk guy hit a tree at over 60mph and die.
Just looking for verification from what I have been informed of.... we do have some LEO buddies on here and if this verification keeps one of us off the road after a few drinks then this thread will have served its purpose.

I completely agree with this. If you arent breaking the law then you have nothing to worry about.

I'm sure by people posting randomly your thread will stay at the top of the list allowing a leo to view it.
I have been hired to keep threads that appear on the main page on topic.

i have no issues with it. a broken taillight and they pull you over a give you a breath test. you broke the law... your taillight was out. maybe you knew, maybe you didn't but it still remains, don't break the law and you won't get breath tested

Geezus people. Let's use the good half of our brain gave us and think logically here for a second.....

If your on the way home from making overtime so you can feed your family and your kids can have the braces they always wanted for christmas and ARE NOT DRIVING on the highway LIKE YOUR DRUNK OUT OF YOUR GOURD, then you probably wont get pulled over.

Buttttttttttttttttttt................

If your a retarded yahoo that's acting like the highway is your own personal playground, then you might just have to worry a bit.

And YES, if you've been drinking and an officer pulls you over and breathalyzes you and you blow less than a 0.08, then your in the clear. He could probably try to take you in, but I doubt that the charges would stick and would probably be a whole mess of legal implications for the officer if he did that.

COME ON PEOPLE...............THINK!!!!

And like one other person just said, if your aint right on your car and a cop pulls you over for THAT infraction and comes to find out you've been drinking, THAT'S his probable cause right there.

So, let's recap:

1) Keep your on and in your car legal

2) If your gonna drink, space it out so you dont ingest more than the legal limit

3) If you drink and drive and are above the legal limit, then YES, you deserve to be pulled off the streets.

Do I drink and drive sometimes? Yes. Would I be all but hurt if I got caught with a DWI ir DUI for being over the legal limit? NO. I WAS BREAKING THE LAW!!

Plain and simple.......

if this thread keeps someone off the road, that good, but they are staying off the road for the wrong reason. They should stay off because they have been drinking, NOT because the leo might catch them.

LEO or not the danger does not go away, it goes away when the drunk stays off the road.

I like the sign that says, buzzed driving is drunk driving. Its true, no one can honestly say that when they are buzzed they can do anything 100%.

I skate and play bass 200% better when buzzed.
