Aprilia, accident, buy back, settlement????

Some of you may recall that earlier this year I suffered a broken collar bone due to a mechanical failure while riding an Aprilia SXV5.5 motard at the track. Initially I simply wanted a buy back and then I decided to work with a lawyer and pursue a settlement. Well, after dealing with the lawyer for a while it became appartent to me that their wallet was more important than my preferences on who was to be sued. I made it clear that the track, the track day organization, and AF1 were not to bothered. I only wanted Piaggio to make a settlement. Finally the lawyer said that he didn't want a client who was going to tell him, with his 30 years of legal experience, who should be sued. I decided my initial gut instinct was right and my friends at AF1, MSR-H, and track day organization LMS are worth more than money.

Back to trying to get Piaggio to buy back the SXV.
I contacted AF1 to bring them up to speed. They gave me the proper contacts at Piaggio. I contacted Piaggio and within three days, they already had all the information regarding my incident at this point, they agreed to buy back the vehicle. No hassle at all.

Even after all this I consider the SXV5.5 an amazing motorcycle that has ruined me. My level of expectations for power to weight, small bike performance, and the all important "grin factor" are way too high now.

I have thanked AF1 for their complete support during this very overdrawn ordeal. From investigating the problem on the bike to assisting me with contacts at Piaggio and much more their support continues to be exceptional. Micah, Ed, Steve, and everyone else at AF1 have always gone out of their way to do the right thing.

Now that this is practically a done deal it is my opinion that Aprilia and Piaggio stand behind their product and want to make things right with their customers. I appreciate the fact that they are developing new and exciting motorcycles. I look forward to owning a third.

Michael

PS I miss my MH friends and hope to see you when I pass through Texas after I graduate from my dive training in Florida. I may have time during my Christmas break but that's uncertain. If not, see you all in March!

long story short, a blown head gasket on a new motor that was broken in as per manufacturers specifications. This happened while leading a group of "newbies" around MSR-H at a reduced pace. The blown head gasket over pressurized the cooling system and leaked coolant onto the rear tire after it over-flowed the expansion tank. This was confirmed by AF1's top mechanic on their dyno.

I'll look for the thread, I think it has my x-rays too!

I went and looked around. I posted various info in a few different threads. I think my reply covers how it was a mechanical failure. The first motor went at about 280 miles, the second at 1100. The 550's were known for their motor failures and mine was no exception. In the end though, all was made right.
