i have HEARD that it is ALWAYS up to the judge. Not that it is a Law or Rule but then when have they always gone by that also.
That he can DO whatever he wants to so i would maybe call and ask the clerk.
I have heard of a few times guys getting defured or similar with some high speeds involved.
again call and ask what that specific judge may do.

"In order to dismiss a traffic citation by taking one of these classes, Texas law requires the following: you must NOT possess a Commercial Driver License (CDL); you must admit guilt or sign a statement that you do not contest the citation (nolo contendere); and if you were charged with speeding, the citation must state that it was not more than 25 miles above the posted speed limit. There are other criteria, and the court has the final decision on whether you'll be permitted to dismiss the ticket by completing a driving safety course."

I called up most of the lawyers that train460 suggested..and some others...
they say that I should go for a jury trial.. now thats costs 750 bucks extra.. they say that in judge's trial, I dont stand a chance... so it ll be useless to fight in that case..

I dunno wats this ...I dont think Sprecher asks u to go for a jury trial but still manages to get tickets dismissed.. too bad he doesnt handle outside of harris county.

anybody has any ideas??..i m fckin clueless.. cant even take DD..bcos I have two violations.. and DD can take care of only one..wtf!

Hmmm... I didn't read in that link I posted earlier about the class being used to dismiss a violation - it clearly says to dismiss a ticket. Did one of the attornies tell you you were screwed because of the 2 violations?

Also, I read in that site that Texas has adopted the point system which is so popular in other states. It reads as follows:'

"Texas now has a "Points System"! Points are assessed to moving violations classified as Class C misdemeanors. DPS will assess a surcharge when the driver accumulates a total of six (6) points or more on their driver record during a three-year period. The driver must pay a $100 surcharge for the first six points and $25 for each additional point, in addition to any related services fees. Traffic offenses which result in points are designated in 37 TAC 15.89."

it says DD can be taken for one "charge"..I called the court and they say that speeding over limit and overtaking in a no passing zone are 'separate' charges, even if done together!!

wat attorneys say is that a judge is gng to find me guilty anyway.. A jury might listen, but then, I dont want to pay 750 bucks XTRA for jury trial. not worth it. they say going for DD would be the right option if it were only 1 violation. I am suugested that I should try a plea bargain during pre trial. take DD for one.. and take deferred adjudication or watever other offer for second violation.

neway looks like I am not getting any attorney. i have pleaded NOT GUILTY. I will try to work out a reasonable plea bargain. it s a pretty fcked up system, thy just wanna make money.but its ok, happens. plus, these r small things in life when u look back one sunny day!

Can you take defensive driving for one and MSF to dismiss the other since this was a moving violation on a motorcycle?

Sounds to me like DD and DA should get you done. You're just going to have to keep yourself clean for a year.

Why not plead guilty to one charge and not guilty to the other.
maybe the DA will accept that so that he doesn't have to go to trial.

charles french, 713-880-1125 , it's not gonna be as cheap as sprecher, but he's also gotta travel outside the norm to get to ct.

You are right Sir! Lawyers tell me the same thing. Maybe I would go for this.
