not in his name?

If I buy a bike from someone(2nd owner) that has not transferred the title into their name, and the bike is still in the original owners name (1st owner), will I (3rd owner) be able to title it in my name? The title has the signature of the original owners name on it. I tried searching but couldn't find a direct answer.

As long as the second owner's name is not on there, you shouldn't have any problems.

Look at the back of the title. If it only has the original sellers signature and the buyer fields are blank, you are good.

Technically it means that the "second owner" never bought the bike.

Fill in your name and details, get form 130-U form the TXDOT website and your're good.

do it within 30 days or their is a hefty penalty. I just transferred one in my name and the guy next to me had to pay a fine.

That's really good to know as well.


So its ok to transfer the title if only the original owners name and signature is on it, BUT you have to track them down to sign the 130-U.

might have to go through a hearing for the title...

the guy who bought my old f3 from northsideG35 (who neglected to transfer title) had to do so. He was required to send me certified mail re the situation and I got a subpoena to the title hearing.

Is there any way you can get ahold of the original owner. Does the guy you bought it from ahve the info on him.

Oh yes they will. I tried this once, and the lady asked me to initial the little statement on the form about how forging someone's name is a felony. I decided to go back to the previous owner and get his signature. I wasn't doing anything shady; I just didn't know about that form when I bought the truck.
