You can sue anyone at any time. I can almost bet that they end up sueing someone. Maybe even the dealership cause he was on work hours. If they lawyer up, they'll sue anyone within walking distance to the dealership and more than likely end up winning with the morons we have in our society.

Sad but true... At least at this time the wife and family are not holding anything against my brother. I think the police report/discussions have assisted in this.

If the guy that owns the bike didn't have insurance, I doubt that he has much to sue for. (nothing personal) Lawyers won't be standing in line to sue someone that doesn't own something outside of their personal property. If he owns stocks and bonds, properties and vacation homes, then a lawyer would be willing to take the case on a contingency. Rest assured they're not gong to put up their own $$$ to go after something that is a long shot.

The dealership:
I'd worry even less if I were the owners of the dealership because the ride on the bike was an agreement entered into by (a) owner of the bike and (b) the rider that took the responsibility upon himself to ride the bike. It is completely outside the scope of agency between the employer and the employee(s).

To put it in clear words it was an agreement between two people that was not work related and the company did not condone or encourage the agreement, could not have anticipated the situation and therefore could not have prevented it.

It's kind of like trying to keep someone from killing themselves with cigarettes. If you ask me for a cigarette, and you light up at the dealership, that doesn't mean that the dealership is going to be responsible for your death because you died as a result of using cigarettes.

None the less, my condolences to the family of the guy that died, that's a tragic loss for them. I'm certain that guy that owned the bike will feel the pain for a long time for what happened.
