I bet he was already disoriented due to having an accident just before that one which killed the officer.

Remember this....even as safe as you can be, you too can have an accident that kills someone. You can even go through the same senario with different circumstances. So just keep that in the back of your mind. Although we may all not agree with the outcome, I think it is just.

man... I kinda wish I would have known about this I would have showed up and protested that bullshit.. I dont want the man to be in jail forever, or even for a long time...

but if you take someones life because you wernt paying attention while driving IMO you lose the right to drive. End of story.

He could always move to another state where driving really isn't needed like on the east coast but here in Texas, if you can't drive, you can't go to work.

So maybe it's finally time for a cell phone ban while driving? Heck a headset is only $30 these days.

Driver who killed Harris deputy constable gets probation

A Harris County Precinct 5 honor guard carries the casket of Deputy Constable Jason Norling after his funeral in October 2007. Norling was issuing a traffic citation on the Westpark Tollway when he was struck by an SUV whose driver was using a cell phone.

James Michael Legg pleaded guilty to the misdemeanor offense of failure to yield to an emergency vehicle in connection with the death of Jason Norling.

Norling, a 38-year-old motorcycle officer for the Harris County Precinct 5 constable's office, was killed in October when Legg's vehicle hit him as he stood on the shoulder of a busy Westpark Tollway, writing a traffic ticket.

Legg admitted his guilt to visiting County Court at Law Judge John Hughes. He was sentenced to six months' deferred adjudication, three days in jail, a $500 fine and 80 hours of community service.

Criminal defendants who successfully complete the terms of deferred adjudication avoid final conviction, but the fact that they were charged remains a part of their record.

Legg's community service will include lecturing young drivers that talking on a cell phone while driving can be fatal, said his attorney, Kent Schaffer.

"Jim has been incredibly remorseful since the beginning," Schaffer said. "He felt he needed to do something to make up for taking a life."

Prosecutors tried to indict Legg on a felony charge in January, but grand jurors returned an indictment for failure to change lanes for an emergency vehicle, resulting in death or serious bodily injury.

Punishable by six months in jail and a $2,000 fine, the 2003 law requires drivers to change lanes or slow to 20 mph below the posted speed limit as they pass.

If they did that i doubt it would be enforced very much. Kind of like using your blinkers/turn signals. If cops gave a ticket everytime they saw someone not use your blinkers the state, city, county, whatever would have a more money.

headset and having your phone to your ear is the same thing. regardless if you have that other had on the wheel or not you still are not paying attention to the road, just what the person is saying in your ear.

3 days lock up, 6 months AD, fine & 80 hours CC educating other on the dangers of driving and talking on the cell phone... a bit more than just 3 days in jail.

Could have have been better or worse.

i think the guy should lose his license for several years, have the guilty plea and charge on his record for life, and have to pay restitution to the family of the officer....and out of all those he should be paying that restitution for life, as long as the officers family would have been supported by him doing his job.
