PO saw it one way, he was over-ruled by the judge. People make mistakes. The PO was cool, and way more patient than I would have been. I would have stopped arguing with the guy, handed him his ticket, and said "have a nice day". PO went out of his way to help the dude understand why he got the ticket. Besides, it was quite obvious the dude was trolling to get a ticket, he would have wasted his trip driving 30mph on the whole tail if he didn't get pulled over.

The point is, you don't have to. That's why most folks pay a lawyer to do it for them. Most of the time, the lawyers talk the case down way before it ever goes to trial with the ADA. Otherwise, you're wasting your money with a lawyer.

Case in point, I had a ticket in Houston, went to court on my date, they asked what I was going to do before I even ever saw a judge. I told them I was going to ask for a trial by jury. Ten minutes later, ADA asks me to come to the conference room and works out a deal with me if I plead "no contest". I walked out without spending a dime and paid my court fees.

I think that is incorrect.
I'd be happy to concede that, but I'm relatively sure that with class C misdemeanors, that is exactly what most people do.

Like I mentioned, I have never had to have a lawyer (more knocking on wood), so I don't know first hand. I'm sure each City or County or State has it's own rules regarding this too- but in Houston, I'm pretty sure you don't have to be there for traffic offenses.

Good point, but the point I was trying to make was a police is part of the executive branch. he executes orders of the law as he sees fit within his discretion. Any party who has a problem with it can go to the Judicial branch who is really supposed to be in charge of the interpretation and or any grievances with the system .

You dont have to depending on the offense. I have represented many a client who was unable to show. any principal (the client) can get his Attorney-in-fact (me, the legal representation) to act his fiduciary (relationship shared between the two parties) This is granted under the Equal Dignity rule
