but i guess you all missed the excessive speed part. or the hitting the bumper with his head (helmet could or could not be present) and what did he do to cause her to throw the beer can at him? or was it just littering? should she be just/also charged with littering? I am just going by the article.

Well, it seems to me that's assault with a deadly weapon... reckless endangerment... assault (by itself)... and as the cause of the accident, her insurance should be liable.

Was he wearing a helmet? Was he speeding? perhaps he wouldn't be dead....

Even speeding - that's not how to take care of it...

DA offices usually charge the suspects with the highest stature under the law to go into proceedings. they usually drop it down so it sticks and seems probable under the law. (getting her for even speeding charges is still getting her for something vs. not getting her for criminal neg or something like that) how do you think attorneys get your speeding tickets dismissed or turned down for a lesser when you cant do the same usually? because Pros knows how to pick and choose their battles and try to avoid trials (you have to remember DA's are usually the guys/girls who barely passed lawschool and dont want the competition) the loss goes on their record and hurt promotion.
