Exclamation Need Input

Ok guys I have a question and since I know the guy I'm talking about isin't on this forum I can ask my question to you guys.


My gf bought a bike and has since decided she doesn't want it anymore since she stole my F4i from me.

Well her best friend and my roommate doesn't have the credit to buy a bike so he offered to take over the payments for it which she agreed to.

Well it's been about 7 months and he keeps paying her halfway into the month and sometimes a month late. but thats not the bad part as long as he pays her she doesn't mind that. what she minds is the inspection and the plates expire this month. and he doesn't want to renew them.

On top of that he refuses to put insurance on the bike stating that "if i get pulled over I'm just going to buy it that day"

I don't have to tell you how absurd that is but I am wondering if there is anyway I can make him get insurance on it without off my roomate.. I've even thought of getting a cop to pull him over and ticket him

hehe what should I do? I dont want to take the bike from him because he's a great friend and thats a year's worth of bullshit i'd have to deal with.

man you seem to be in a pickle, lol man sux man what actually is goin on is hes taking advantage of a situation. hence why hwe has no good credit, to begin with, if the guy wont pay banks back he sure as wont pay your girl back seriously, he needs to wake up and she should make him pay on time or sell the bike

Get him a quote and let him see how reasonable the cost is, i would NOT let him RIDE/HAVE that bike w/o paying for insurance. If he can pay to repair or replace it himself then he can pay her in full!!!

Get insurance or gimme the bike, AND have a cop pull his a$$ over so he can get stuck with the NO INS ticket.

hehe yeah anyone know of a cool cop that can mess with him when he leaves for work?

he's more then welcome to write him a ticket then yell at him for not having insurance that would fix the problem

the payment thing really isint that big of an issue because he pay's on time when we remind him he's just forgetful so that can be fixed but I want insurance on the bike, im sure I can convince him he has to get it since it needs insurance to be inspected but we'll see.

insurance isn't that expensive man! even if he get liability. it's not that bad. something is better then nothing. And if he gets caught without insurance and has no proof it becomes and sr-22 on his license if i'm not mistaken. plus a hefty fine. and the same day BS doesn't work..

Don't understand why anyone would personally extend credit for a recreational purchase to someone that a bank wouldn't loan money to. Also, allowing someone to take over payments is a bad deal for the seller. Seller gets all of the risk for zero return. However, it looks like that horse is already out of the barn.

If the bike is still in her name, you (really she) still has control. Don't make allowances for late payments (does her lender allow her to pay at her convenience?). Does her lender not require insurance? The guy is abusing her and the relationship, whether he realizes it or not. Best thing to do is cancel the agreement and sell the bike outright.

At the very least you should, establish ground rules and write them out, have him sign them or repo the bike immediately (don't worry if he gets - better that he be upset than the two of you).

Consider including in the agreement (I'm not a lawyer):

1. Payment schedule and due date. late payment fee of $10 (or whatever you make it) a day. More than 2 weeks late, bike is repo'ed and the deal is void.

2. Insurance - GF should keep the insurance in her name and pay it herself so that she knows she is protected. He should pay her the premium amount one installment in advance with his bike payment. Insurance payment not made constitutes default on the loan

3. Registration - she should pay the state and charge him back, again so she knows that she is protected. There's enough lead time for him to pay her before she has to send it in.

4. Inspection - leave to him. But make him agree to maintain it.

5. Damage/theft - my guess is that he will expect her to eat it for his lack of insurance. Make sure he agrees to cover the deductible for the policy that she maintains.

If this is not suitable to him, cancel the deal and repo the bike. Remember that she is doing him a huge favor and has assumed significant financial and legal risk on his behalf. He needs to be worthy of it.

Your statements don't add up. What is the defininition of a "great friend" these days? It must be different than what I was taught.

well I havent talked to him about it yet, only she has. and I live with him. so i'm gonna have a talk with him about everything soon but I just wanted you guy's input.

I know your all on my side and I think we can work all this out with him getting insurance on it and owning up on his end but I just wanted suggestions on how to go about bringing it up with him w/o making him feel like i'm attacking him instead of just telling him look "im helping you out but you have to help me out"

Go rent a storage, and when hes gone and not on the bike, move the bike to storage. Then when you know he is on his way home, leave, and leave the garage door open (if its an electric, pull the rope thingy and leave it open), then come home after he does and say its must have been stolen. Seeing that its yours, you will have to file (but you dont). After a few weeks, kick him out, and bring your bike home.

Very simple: Tell him that she is not asking him to do anything that the bank/finance company and law doesn't require of her. There is nothing unfair about those obligations being passed on in the deal.

If i'm not mistaken they can go after the registered owner of the bike...no insurance means they probably can take to her...i think civil court...and sue her...

also, is the bike paid off by your g/f...or does she still have it financed? Are you or your g/f willing to put up the money in case the bike is crashed and he stops paying you? I mean great friends are great...lol...but when in tight situations they will try to be the "victims" and try to get out of it...IMO...get the bike back or make him get insurance.
