Apartment Manager

I've lived in 2 apartments for the duration of living on my own. First no problem, full deposit refund etc. 2nd is the one i just moved out of. Lived there for 3 years+. Was late 1 day maybe 2 times on my entire tenure there, every other month i was 1-2 weeks early. pretty much pristine relationship with managers office, until the new manager moved in. She's a stickler, and that 2nd time i was unable to get off work to bring check in before they closed, even though perfect history (and other manager had told me not to worry about it), she was very much nasty about it and told me $50 late fee period.

We just moved and i didn't think it would be an issue of refund security deposit. We had a cat and had maybe 4 stains in the house, VERY faint, but noticeable. We paid the apartment to clean.

Carpeting was poorly installed and fraying, and worn. It was time for the time replace anyway. Tiles coming up in kitchen, you can tell they were going to have to do some work. Pretty much everything else was pristine.

They just sent me a bill for $150, for the stuff i paid them to clean.... AND replacing living room carpet... @ over $400, so after $150 security, and cat deposit, of $400ish, i still owe them $150 they say.

I took some pictures with my cell before i left of the stains, but being trusting didn't think they would screw with me and should have gotten video and timestamped pictures. Which i didn't.


1. Any shot of me getting them to reverse charges, and give me deposit, or pretty much hopeless?

2. Any shot if i take them to small claims to get this refunded.

3. Can they reflect the remainder bill onto my credit if i don't pay it? I am a debt collector, but i don't even know this one. Being sent to collections doesn't bother me, hitting my near perfect credit does.

4. Advice please.


I won't be that naive again. I guess we all learn the hard way, not to be too trusting.

apt management owns you pretty much. trust me from experience. you either pay, or it goes on your credit. theres pretty much nothing you can do about it.

Lol. We cleaning everything up really good and are clean people. Not slobs. But a hairball that he let up overnight and we found in morning was scrubbed on and left a reddish tint. LIGHT.

Again, we're not talking about stuff you see from the other side of the room, but about small stains on an apartment that was due a carpet change anyway.

I've always paid my bills and have near perfect credit. The charges seem unreasonable. Remember I paid $400+150 in deposits.... so=$550 in deposits... They want $650 for one room for 3 LITTLE stains? Thats unfair i believe.....

heheh you could do what i do and tell them to go play hide and go themselves. however it will go on your credit and you'll get nasty little cell phone calls from collection agents for .. lets see going on over a year now...

but heck i still was able to finance my new 1000RR so it cant hurt that bad.

I do have a question about the carpet....

When you moved in; did you do a walk through on the place to make sure everything was up to par and nothing was wrong what so ever? and did the cat mess up the carpet overall or was it just from wear and tear over the years?

I lived with my roommate for 3 years and we had two dogs...total deposit was 500 for both pets...but since we had lived there for so long they were replacing the carpet anyways since they are supposed to change it every 3 years no matter what.

But your deposits should have been more than enough to cover replacement for that one room or any cleaning that needed to be done...

The thing is with apartments like you said earlier that the manager before this one was a lot nicer...I would send something certified mail..this way you know they have the letter and your complaint and they are not going on hear say. Also I would send a letter to the corporate company and seeing if there is a way to work this out...If they kept the pet deposit and full rental deposit then there should be no beef...if the tiles are coming up...they should have been notifed of that when it was happening and it should have been documented. That way when yall did move that was something that was there and they had not come to fix yet while yall were still living there. On your walk through you should have made any remarks regaurding the carpet, tile, walls, fixtures anything that needed to be fixed are was already there. Pictures help so much when you first move in; and when you are leaving. personally if she is already treating you like this..I wouldnt be too keen on dealing with her in person anymore and just sending cerified mail..that way you have proof that she is not being very responsive as a manager. send the same letters to corporate.
