Lawyers will typically go the other route and indicate that they will sue for much more than that so that the other party is intimidated into offering a settlment for a more reasonable sum. Frankly, I would too. Basically "If you don't do what's right, here's what we're going to do to you..."

He just pulled out of his driveway? Check the homeowner's insurance policy, if he has one, because they might cover it. It's amazing the things that homeowner's insurance will cover.

Well he pulled out and drove about 50 ft. and then was hit.

I didn't think about checking on his expired insurance. Can you just call there company and ask them if there policy is current?

I'm with most here, but I'd lawyer up.
If all the cards are out and correct, then this should be easy. Find out about the recently expired insurance. Find out who the owner is and if the vehicle is indeed insured. So many routes to go with this one.

If the suv driver didnt have it then, I bet he does now. Its stupid to be underinsured. Think how things would be if he had been hurt bad. This thread would be about donations.

Take him to civil court.
If he has anything at all it can be liquidated to pay his liability, they can even garnish his wages.
Go see a good lawyer, Jim Adler comes to mind.

Sorry I missed this one!!!

From an insurance perspective. I would call the insurance company and file a claim. Let THEM tell you he's not covered and formally send you a denial letter. Sometimes people just forget 2 put new ID cards in their car, or they just might have a small grace period where coverage is still available. SF is like that when ur policy automatically renews every 6 months and u still have about 30 days 2 get ur renewal 6 month payment in and up until that point the policy is still active, (paying monthly is a LITTLE different, but a grace period is still there).

If ABSOLUTELY no chance of insurance paying, id' get an attorney and he/she will go after both the driver and registered owner if i'm not mistaken.

My friend had a similar situation with a drunk kid hit lost control and crashed into my friend's PARKED car. The kid (or appropriately a worthless, job-less, low-life 20 y.o. punk) who has no insurance on his beat up '80 Camero (actually he made a fake insurance card to pass inspection as we found out later). Cops took him away for DUI etc...Anyways, my friend got a lawyer to send him a nice demand letter. This kid actually took a Xerox of his naked a$$ (nut and all), signed it and mailed it back. Talking about hardcore nutcase & have nothing to lose. The lawyer eventually dropped the case and actually said "can't squeeze water out of a rock"...my friend ended up eating the damage. Good thing is the lawyer fee was free (free service for student). End result sucks but funny nevertheless.

Well he talked to the dude and he said that he does not want it to go to court and that he is willing to pay for the damages. He seems to really want to cooperate and take care of the problem, for now anyway.

Thanks for the advise and if nothing is resolved soon we will send the letter.

He is also in the process of filing a claim through the insurance company even though it's expired and see what happens.

Don't trust him, still follow through with at least a lawyer, a free consultation. Then I personally would tell the guy, a lawyer is at his side. I've seen it first hand with my wife, at first they wanna cooperate, then when they realize it's just a handshake, and they are going to have to fork out a significant amount of money, they back out. Why wouldn't they, there is no 3rd party, legal rep, family or what have you to ensure they follow through. Don't go on his word, especially being so young...
