Someone pulls out in front of you and?

Its your fault or their fault if you dont stop in time?

Saw this SUV pulling out, open four lanes, traffic was busy but fairly clear at that moment. The SUV almost went into the lane to my right (I'm in far left) and instead keeps going and gets infront of me .... 20ft left, I already had the clutch in the moment I saw the SUV pull out but, I think it was that moment of hesitation to go around that blew me. Something in my head yelled at me to stop, not to change lanes... so I might have seen a car out of the corner of my mirror? Who knows, plenty of questions I could ask like why did she stop in the street once she was out even thought before she did I had no reason to stop (no red light). Doesn't change that we hit, and no one is hurt so thats all that matters.

Anyway, who has been here before and what did insurance say as to who was blamed?

possibly still their fault if the police can deem she pulled out in front of you. you had the right of way.

...best for that situation, to have an officer come over and do a report and could go either way.

In theory, I think the burden is on the person who rear-end the person ahead of them... if it had been a side impact, they would probably site the other for failure to yield.
With front/rear impact they might feel/argue that if they driver had sufficient time to cut across traffic and get ahead of you, that you had sufficient time to react and adjust your speed etc.

Good luck and glad you weren't injured.

most of the time when you hit someone from behind its your fault but it sound slike it shouldbe there fault on this one...the should have pulled out to the closest lane not the furthest

yep, known someone who got brake checked on......and the person that did the brake checkin got the ticket and was deemed "at fault".

but they had a witness saying the other car slammed on the brakes with nothing in front of them but the road. (insurance scam gone wrong ) pooor guy jacked up his car expectin to get paid. asshat.

yeah, thats what I have always heard, didn't andmit to anything at the time just exchanged info

on the plus side the only damage to the SUV was a cracked (fog?) light and scratches, nothing more than paint deep. Was wishing I had a camera though.

i had an idiot pull out right in front of me, too. he ignored the 'yield' sign, merging right into my lane. i rear ended him in my cage.

no police was involved, but i talked to him and he knew he was wrong. his insurance paid everything.

but couldnt have been much more then 10 over we were on 45 were all the cops sit


I was passing some one, and the person in front of the person i was passing moved over, and there was a car in the other lane.

Could I have done something different? I dunno, probably, I only had a split second to react, maybe it was the right one maybe not.

IF I was speeding at all, it wasnt more than 5 over, speed limit in that part of Westheimer is 40, however, Im pretty sure I had my speedo reading 40 at the time and its usually about 3mph higher at that speed.

I probably hit doing considerably less maybe 10? MAX but no way to know for sure, didnt feel that hard, but adrenaline can do a lot to you.


and Ive always been picky about going the speed limit in that area unless its after midnight (cus then youll get run over)
