where were you when it happened...harris or montgomery county? i might be able to help you out if it was montgomery. and if it was harris county i know a lawyer that wont be too expensive and probably get you dismissed no chit....why dont you get one of those tittle loans on your bike so you dont have to sell.....keep your head up

the cop said he could smell it , and i wasnt going to lie to his face , so i said i had the one beer. he didnt ask me to blow. didnt go to jail. i got an MIP about 3 month ago so i think im really screwed on this . this was in college station (brazos county) where i go to school. not going to lie im getting kinda freaked out on what is going to happen. im going to fight this thing as much as i possibly can

there was no beer in the car, i made everyone leave it at the house. everyone else in the vehicle were drunk that is why i thought i would drive since i had one.

Lets step back here you said that you didn't blow or go to jail right? Because a DUI/DWI is a class B and they have to take you in for that. Did you do a field test or anything of that nature? Did you actually get a ticket for DUI/DWI?

Since you are under 21 it is illegal to have ANY detectable amount of alcohol while driving.

I would get the best attorney you can get because if it goes on your record it can make the difference of where you can get a job.

Also there is a free Service called CARPOOL that will take you home in the Bryan and College Station area that operates every thursday, friday and Saturday nights and they take calls between 10pm-3am. The phone number is 979-693-9905.

Some good advice in this thread, and inevitably some bad. You screwed yourself on this one by admitting that you had drank. Since you are under 21 and admitted to drinking the cop has no reason to give you a breathalyzer and they will even refuse to it if you request one. He could and should have taken you directly to jail and had the vehicle towed. You got off very lucky that he didn't, you saved impound fees, bond fees, and the worst part...a night in the drunk tank of the jail. Get a lawyer and show up to your trial. DWIs are the hardest cases for prosecutors to convict so they will generally just plea you down to a lesser charge especially if it's your first offense(not considering your priors), this is because the jury generally emptahizes with the defendant because they have all atleast once gone out somewhere, had a few too many and drove home.

Cliff notes:
1.) Tell your parents, they will be highly dissappointed but it will be much better for you to tell them straight up then for them to find out when you're begging them for money to help pay off your fines down the road or trying to explain why you are doing community service.
2.)There should be many lawyers around College Station, almost all will do a free consultation(first 30 minutes free) and you can get a good feel of who is right for you. If you don't find one let me know, I have a friend who was a lawyer that was also a professor at the school and he could reccommend one I'm sure.
3.) Plan out your finances and prepare yourself for what you will need to spend later. If it comes down to you possibly having to sell your bike to pay off future expenses do it now. You don't want to get stuck not having the money when the time comes, forcing a quick sale of your bike which will leave you with less than you could have made by being patient.

If you go to A&M they will have a free legal service. Contact your guidance office and they should be able to give you the #. Schedule a time and go! You will get to sit down with a real attorney who will offer you a lot of great first hand advice that the majority of us on here cannot do. If you have any questions please feel free to ask, if I don't know the answer I'm sure someone else does.
