they arent felons. dwi or dui is not a felony. its a class c misdemeanor. and yah they would have done it again, my brother still drinks and sometimes drives even though hes been caught and has gone through a dwi situation.

on the other hand i agree with racer x, i would have stopped since i saw the wreck, but once i found out it was because the guy was bar hopping, i would have called the cops.

I was there 3 weeks ago on 290 & huffimester with the head on collision where the drunk guy entered the exit onto the wrong way. Truck was on fire cutting the guy from the seat belt ............NEVER did i hear i person say well we smell achol. & maybe we shouldn't help this guy ......

I am with RacerX on this one...

- I would definetly help (as RacerX said he would also)... as he is a biker and has been involved in an accident... but as soon as I knew it was a alcohol related, I would call the cops...

- If I witnessed an accident, I would most definelty run to the innocent individuals affected before running to render aid to the moron(s) who committed the crime...

- Why does everyone jump on RacerX because of his opinion? His opinion is mature and make sense most of the time... back off and just do what you think is right....

ok then... just to clear up the legal part of this... a DWI is not a felony (at first) and it sure as isn't a Class C misdemeanor!

1st offense- Class B misdemeanor with MINIMUM jail time of 72hrs-6days depending on if there were open containers in the vehicle at the time.

2nd offense- Class A misdemeanor- Minimum confinement of 30 days

3rd offense- 3rd Degree Felony- sentencing up to the judge but could be 2-10 years in PRISON...not county jail. plus up to $10,000 fine

Of course all these change when someone is killed or injured or a severe amount of damage is done...those are just for getting caught DWI/DUI with no major accident or injury.

Just want ya'll to know what you're getting into and what could happen the next time some of you decide to drink and drive.

and i'm not talking about picking them up off the ground, dude loaded up 2 bikes and took em home for them on 2 seperate trips.

I wouldn't think too much and analyze what type of people they are, and then decide as to whether they deserve my help. They could all be innocent if you really don't know them. I'm sure all of us have done stupid cause people we know or don't know egg us on. It COULD have been the guy's first time to get bold and do something stupid. You never know. The guy helped someone without question, and that's what really counts. If you want to decide whether or not it is worth giving a little extra effort to someone you think is "deemed worthy" of your immediate assistance before calling the cops, that's pretty low.

it's not being advocated to ask if they're drunk before stopping to help, so i don't see where the conflict is...

I'd do it... cop will make sure EMS gets there and takes care of him and that bike was legally his etc.
