LEOs, I need some advice!

I got a call at work from my mom saying that she was feeling sick and thought her diabetes was getting out of control. SHe called an ambulance and refused the ride because she's uninsured, so they told her to have me take her.

I'm doing about 90 across the beltway and on to I-10 out toward katy. (Just to clarify it was about 00:15 and there were very few cars on the road) When I hit the new section of I-10 at Hwy 6 I see the old red and blues and pulled off the highway to the service road, then pulled into a parking lot. The officer says the undercover Sgt. got me @ 100 in a 65 (which I know is bullshit, but I'm not in the mood to dispute this) and he HAD to issue me a citation, even being aware of my situation.

So my question is: WHEN I take this to court, what kind of chance do I have of getting a slap on the wrist? Will the prosecutor make a deal with me? Will the judge even listen to me this time??? It seems like the entire CoH Municipal Court system is a joke, but my situation is very serious.

Any and all advice is welcome in the form of PMs or posts, I just want some perspective. TIA.

BTW, those new police chargers are looking sweet!

you can try your luck in court, but it'll depend on the prosecutor and the judge as to what they want to do. however, there is a part of the traffic law (don't feel like looking up the exact code at 3am) that states if the reason for speeding outweighs the risk caused by the speeding then it is a defense. however it is NOT an Affirmative Defense... it just gives you a legal defense to the violation. The judge can still find you guilty and all that jazz... but it's worth a shot.

Get any paperwork you can documenting your mom's issues on that day AT THAT TIME... the prosecutor can/should work with you based on that.

I wouldn't suggest taking it before a judge, he would (likely) say that if it was such an emergency, you should have let the ambulance blah, blah... you know the rest.

BTW... I once stopped a lady who claimed her son was just in really bad 4-wheeler accident and she was on the way to the hospital. I wrote down her info then quickly let her go... when I called the hospital the next day, they had no record of her son being there, so I mailed her the ticket.

Just saying, people come up with all kinds of retrded excuses, so you'll have to PROVE yours.

@ 60mph it'll take 5 min.
@ 90mph it'll take 3.33min,

that ~1.5min you saved prolly ain't gonna make a diff. , but now look at all the hassle. add the police stop and you've lost your speed advantage.

and of course, if you have to go less then 30min, the time savings is even less.

going more than 25mph over omits you from taking defensive driving. You can go on probation, pay some fines and it'll go off your record.

Take your mom to court with you with any documentation from the hospital and the courts may take it into consideration. When I went into labor with my second child we were doing 90 mph on the on ramp to I45 and a female highway patrol pulled us over, keep in mind my water had broke in the car and we were going from Kuykendahl and 1960 to Galveston for the birth. The officer came up and asked how I was feeling and I told her I could feel her head and she kept us on the side of the road for 30 minutes. Tim was pretty by the time she cut us loose and told her she might as well radio ahead because he was not stopping again until we reached the hospital... This was at 12:30 am we got to the hospital at 1:30 am and she was born at 6:10am. We took our new born daughter and the ticket to court and the judge reemed the officer and shamed her in front of the entire court and all charges were dismissed.

Assuming I am reading this correctly, the difference is actually 10 minutes.

If you are doing 60mph and need to travel 30 miles, it will take you 30 minutes (1 mile per minute). If you are doing 90mph and need to travel 30 miles, it will take you 20 minutes (1.5 miles per minute). Depending on the type of emergency, 10 minutes could mean life or death...

Oh I love it when they reprimand cops. That is awesome. Our first daughter was born galveston too. I was doing over 90 getting there too from Friendswood. I saw a cop pulled behind him asked for an escort and they say they don't do that anymore. And I said ya'll really need to get get rid of the Protect and Serve and put Harass and Detain on the side. Then I burned out in the olds 98.

Yeah, because passing up an entire medical center and umpteen other hospitals to get to one is a good idea and a true emergency. Besides, you pulled in behind him? How is that harassing and detaining you?
