Anyone know something about child support?

I was introduced to the lovely thing known as forced child support (I've always taken care of all my 2 1/2 year old daughter's bills since her mother just recently graduated from med school) last December and now I'm losing my job.

I'm a contractor (web developer) and make good money but from time to time I get a little while off in between jobs. No big deal, I budget for it and it gives me more time to relax and I can go to my muay thai classes every morning. Anyway, I called the child support office today about getting my payment reduced from it's now 4 figure monthly level and they said I can't modify it before the order is a year old so I have to make the same payments even when I'm not working. Other than working it out with my baby mama where I pay her a reduced amount we agree on and she signs the affidavit saying I made the full payment, is there anything else I can do?

I'd rather not spend $3,000 on a lawyer to get my payment reduced for a couple months, so I'm looking to see if anyone else has been in this situation before.

Do your payment go through the courts? If not you and your ex can work out anything you want, but if it goes through the courts you will need to get in front of a judge more than likely.

you will have to lawyer up and goto court to get the amount reduced. and the amount is hard to get reduced. the courts aren't gonna let you off the hook cuz your taking time off. and i bet your ex is gonna fight it tooth and nail.

might as well saddle up and get on that work horse again.

and getting a lesser paying job and going to court isn't necesarrily going to lower your payments, they wil take into account your last yrs wages. this ain't the first time peeps have tried to lower their income, to get a lower payment amount.

amazing how naive people are about this stuff.

If you have court ordered child support that you pay through the state, you must pay the amount assigned to you.

If you are "just paying it" to her not court ordered, then you can reduce your payments or whatever you guys agree to.

It sounds like you have court ordered support payments and the only way to get them reduced is to go in front of the judge and show that you are out of work or your salary has decreased or whatever and you can get a "life change" modification.

Oh yea and....

Informal agreements between the parties are not binding on the Court. If you rely on the agreement of your former spouse that you can pay a lesser amount of child support, you are likely to find yourself in contempt of court, as you have violated the Court's Order. If your former spouse agrees to give you primary possession of the children, and then demands return of the children several days later, you have no enforceable right to retain possession. If such agreements are reached, contact an attorney to have them reduced to the form of a court order

I pay over 4 digits a month and she makes more than me. Read above. I put her through MED SCHOOL. How much does a 2 1/2 year old need? Her daycare is $400 a month and there's the food and clothes expense. Am I supposed to pay for everything and more? It's both of our's responsibility. It also feels good when I pick her up and the BM's wearing a new Prada purse.

Not sure why everyone thinks I'm just taking time off to lay on the couch. I found out yesterday at 4:30 that I only have 7 more days on the job and it's not like I can just snap my fingers and get another job. I can live cheap and I have a little in the bank, but it's not fair when I have to pay 20% of my salary even after I lose the job.

Yes, it's paid through the courts and gets taken straight outta my check. That just happened without my knowing. Add to that, the decree was submitted (I didn't get a lawyer cause the lawyer I talked to said she'd take my money and go to court for me but the judge wouldn't go lower than 20% if the baby mama asked for it) saying I would start on 9/1. The divorce wasn't final til late October so I was automatically two months behind even though I was paying for everything straight to her up until then. She signed the affidavit saying I made those payments but there's like 3 different agencies (state attorney general, county family courts, county disbursement) and I now have that on my credit report and all of them say I'm paid up and each tells me to call someone else.

</vent>

I have two phone interviews tomorrow so wish me some f'ing luck.

you have a cheap daycare, cuz mine cost $520 a mos. and i consider my place cheap.

and yeah, C/S sucks but your responsibilities to your child don't stop if your laid off.

these are things you need to think about before getting divorced.

and G/L w/ the job.
