sorry I should have said you are required to dip your beam as you would in night driving.

Other thing I tell my classes is we have you shut your bike off with the red switch check your manual and see how the manufacturer wants you to shut down once you leave this class.

I know that in most cases if you show at least a little effort and some factual information the judge, or in this case the jury will let you off with at least some probation.

Hmm... sounds like I'm going to have to appeal to the common sense factor of the jury. Even if I am wrong, I think having the DPS manual that says "90 degrees to the curb", plus a picture from a progressive commercial that shows a motorcycle parked the same way (I would think an insurance company has it right) might be sufficient as an affirmative defense excuse as mistake of law. Trial's Jan 15th, so I'll definitely let yall know what went down. I have a feeling a lawyer would have no problem with this case

ask the officer to describe how your bike was positioned first before presenting the pic...catch them in a lie perhaps...the way you parked will only make sense 1 way according to the story you both told.

get a lawyer (real one) either way its gonna cost you at least with the lawyer youll win and the viscious little circle of law will be happy cause somebody in the law community got paid. its a scam any way you look at it.

Yep. It's the same as a speeding ticket.

I even turn on my in car cam and make sure I record the parking violation and get the vehicle's plate. I'm goooooood.

As far as the original poster's question, technically he was illegally parked. Transportation code was written with 4 wheelers in mind, unfortunately.

IMHO..................if the judge sees how much stuff you have gotten together & how upset this has gotten you.....He might/jury see it your way i mean come on the officer might have to re look at the law again to make sure he doesn't ( make a mistake ) over look something ...........

Yes we do show up for parking tickets... to us its the same as a speeding violation... some departments are required to go and some are not... depends who issued you the citation...

in some cases the bike could fall over due to the grade of the road. that and the fact that there isn't an e-brake is why you are supposed to park it in the manor that is in the dps book.

We only have a kickstand on the left side and most raked for waterflow. How the are you suppossed to park the same way as a car and not get your bike tipped over by a strong wind?

I agree with the picture taking also, I've done it and it made all the difference in the world to the judge that I was prepared to defend my position.
I won, after she saw the photos.

Some good advise on here. Show up with the books and the other material and I'm almost positive you will get out of the ticket. Sucks you even have to go to court in the first place, but ish happens.
