Thumbs down Benton Receives PROBATION For Teen's Murder

HOUSTON -- A 17-year-old girl who faced a murder charge for fatally stabbing a member of the notorious MS-13 gang during a brawl in a Houston park last year has pleaded guilty to a lesser charge and will avoid prison.
Ashley Benton entered her guilty plea in court on Friday after agreeing to a plea bargain with prosecutors.
In exchange for pleading guilty to aggravated assault, Benton was given five years deferred adjudication probation, meaning if she completes her sentence without any problems, her conviction will be erased.
Benton must also complete 300 hours of community service. She has been ordered to pay the funeral expenses of the victim, not to exceed $4,000. Benton must also submit to random drug tests and earn her GED or high school diploma.
Benton had been set to be retried in January after her first trial earlier this year ended in a mistrial after a jury failed to reach a verdict in three days of deliberations.

4,000 isn't enough to cover a decent funeral. I can not believe that she is only getting probation and being cleared of her crime. I don't care who she killed or how old she is. She should face the consiquences like every other grown man out there

dayum that's wrong. I bet she will end up serving the time in the end. 4 years is a long time for a kids to stay on the straight and narrow.

Oh I agree on that part, don't get me wrong. But I don't think this is a case of self defense. This is a case of her rolling with a known gang and got caught up in the fight. She should be tried like an adult murderer. She was involved in gang activities, running around with known, gang members, and murdered another person. Had they put her in prison for life, that would have gotten 2 off the street instead of just one.

I personally think this is one of the stupidest conclusions the courts came up with. Here her lawyer is saying she did it out of self defense when she willingly put herself in that situation in the first place. She knew what was going to happen if she hung around that crowd and yet she did it anyway. What a waste of tax payers money for her to be sitting in court. Now she is going to put herself in more danger with a deadly gang as well as her family and on top of that, she will more than likely break her probation because these people will more than likely not leave her alone.

I am not too sure, there is MS folks in prison, but I think because of her crime they would have her seperate from the rest, especially because she is 16 or 17. Regardless, that will not stop that gang.
