At what point is it okay to shoot someone? (keeping the facts of this case in mind)
The law states you are able to defend you or your neighbors property..

Mr. Horn states that they came into his yard, in that case I feel in my opinion he was lawfully and morally right. Killing somebody is not something anybody in their right mind will feel content about..

"or to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property."

I did not read the entire post, because I dont have time to.. But from what I picked up, I may be mistaken but this applies, right?

So the question would be if there were a verbal or writen agreement from the neighbor to "watch" over his property? This should be intresting in court..

Edit- Maybe, if he can prove he "belives" he has a legal duty to protect the property...

It's going to be interesting...

1> Problem for horn was his statemetns on the phone
2> Problem for horn was that this happened during daylihht hours.

Unknown:
The actual location of the criminals in relation to Mr. Horn, his property line & his neighbors and the actions taken on both sides following his order/statement to the two men.

...amusing fact, that many (in particular this making statements on how he should be punished) are acting in a manner similar to the very one they condemn Mr. Horn of. Even more...amusing or ironic is that they are doing so based on even less information/knowledge than Mr. Horn himself had in his situation.

There was a home owners meeting down at the park in the neighboorhood. Basically they do not want anymore protests within the neighboorhood.

On the phone, the 911 dispatcher asked him if the neighbors were home and if Horn knew them and Horn had answered, he didn't know them well. He said he knew the neighbor across the street well and would've already gone over there if they had broken in there.

It doesn't seem like he had any agreement from the neighbor to watch over the property.

The only thing that may be in his favor for one fatality is the fact that he did mention on the phone (after the shots) that one of the guys came into his frontyard and 'he had no choice'.
