Well this definetely is an agree to disagree topic. The law states this guy can not be prosecuted for what he did if he had permisssion from the land owner. It also states that any of us can shoot a burglar running with our stuff if it is our own property without being prosecuted. So the law stands behind the majority opinion in this thread. You are just a kinder more forgiving person in this situation I guess.

tell me one situation where a house was BROKEN into by a stranger, without the owner's knowledge, in which the stranger had 'good intentions'
I hope you arent saying that they didnt take anything...it clearly states that when the neighbor confronted them they were holding a bag...then ran...
it was probobly their lunchbox though huh...good point
I guess I would wait for them to actually be inside of my house..

Gah.. NO!

The LAW STATES, the the person has a DEFENSE AGAINST PROSECUTION.

There is a HUGE difference between that statement and your interpetation (COG).

Exactly!!!!!! they broke into YOUR house.... I wouldn't bother calling the police if it was my house because I probably wouldn't live to see them come. Your are ****in retarded. This is suppose to be about protecting a neighbors house not yours.
We have established that you would kill someone breaking into your neighbors house and your house. What else???

When did this law change? I never knew it was at this point now, but you won't be persecuted if he doesn't live.

Dude, you are never fully protected. it is always up to interpretation of your peers (GJ) in Texas. The only time that you can blast them with your property is at night... That is when Texas laws change to the "Wild West!"

Ok I figured I would give yall another girls opinion...

I have worked extremely hard for the house I am buying and everything in it. If someone broke into my house when I was not home I would hope like they were caught, be it by the cops or my neighbors killing them. . .Of coarse I would hope that they didnt HAVE to be killed but hey if they are trying to run away with things I have busted my for then shoot them.

Now if I was home.. They wouldnt make it past the breaking the window and they would havea shotgun in there face and I would be asking MH who had a pressure washer to clean up the mess I made. I would not wait to see what they were doing or give them a chance to explain. I have a 6 year old and I will do anything I need to to keep him safe.

That being said.... Anyone havea pressure washer I can borrow for a day
