I hope that there is sufficiant evidence to prove the charges. Having a vehicle accident isn't a homicidal event in my mind.

Homicide:
Refers to the act of killing another human being

Manslaughter: Voluntary or Involuntary
The unlawful killing of a human being without malice aforethought.

Murder:
Considered the most serious form of homicide where one person kills another either intending to cause death or intending to cause serious injury in a situation where death is virtually certain

Hmm... Homicide sounds about right... although I would press for Murder

negligent homicide.
Her failure to execute her driving safely and not thoroughly check for cross traffic was negligent.
And as No Fear pointed out, homicide is just the killing of another person. It doesnt have to be purposeful like murder.

According to LA Law, it would be considered more than likely Vehicular Homicide...but it only applies if she was under the influence of some sort.

If it was negligent homicide, there has to be a criminal negligence as defined here: http://www.legis.state.la.us/lss/lss.asp?doc=78285

That would be hard to prove. If a person looked and didn't see someone coming, applied a turn signal and took other means but still didn't see someone coming down the road and hit them, you cannot prove that they were acting neglogent. Was she swerving all over the place, was she hauling and then just cut in front of the poor guy? Did the guy have a headlight on? Who's to say that the biker and his wife weren't taking the necessary precautions? Fact is we don't know. I bet that they drop the charges unless the toxicilogy report comes back positive for her. Who knows, the biker could have just left the bar himself.

i just think everyone here will side with the motocycle rider but it is true. they have to prove what she did was wrong.

Factors not detailed could influence... if the zone/speed limit is say...45 and the motorcycle was doing 75-80 for example. The penalty/punishment meted out should be adjusted etc.


In short, nowhere near enough info for us to being to pass judgement.
