Yeah, it's not a position I'd want to be in. I'd want to do the 'right' thing, but at the same time, there are some people who try to take advantage of that. I hate those people.

Like the other poster said. reputation is everything. While one person can't ruin it, they can make things miserable for a while anyway.

What sucks is that there are those that can't be pleased. So even if you do the 'right' thing, they will probably go blab about the 'horrible' experience anyway. Sad.

Hmm.. So yeah, Now I'm stuck as to what I'd do.

I would definately not give her money back because she ( changed her mind) She checked it out prior to buying, if something is wrong with the car is 1 thing but if she just changed her mind, tuff, she shouda thought about that before they both checked it out:/:

In Texas it's "as-is" unless otherwise stated - like with a warranty right?

So long as you didn't knowingly misrepresent any problems with the car then it's all on her, right?

i agree^^

i would buy her a radiator $120 tops from 4 seasons, then tell her to have it installed, whats to say she didnt drive it for a day or 2 overheating and crack a head,block,headgaskets ect.....money back no....radiator yes

I guess you still run some type of buisness, if so that makes it more complicated.

If it was a private seller and the problem was disclosed then SOL.
If it was a new problem it would just depend on circumstances, might help pay for the fix.

Look at it from your side if you were a buyer, how many private sellers are going to disclose all known problems and help fix any problems in the near future after the sale, not many. When I buy and sale I assume AS IS.

i'd say...

this isn't walmart, u can't bring it back b/c u don't like it. u picked it, checked it out, and paid for it, now it is yours. now about the radiator, i'll have my guys take care of it and u will only be charged 1/2 the price of fixing it, to keep me honest u can go get a quote or 2 from some other shops, have them list parts and labor and i'll take care of it.

I bought a bike, first bike. Didn't get the bike checked out by a mechanic. In less than 400 miles, had the rectifier go out, and spun a rod bearing. Difference is, I don't think the person I got it from did anything wrong. Just happened to be a circumstance. While very disappointed and felt put out, I don't think the seller was responsible at all for what happened. Old vehicles break down, that is part of it. I think you are being more than fair offering to cover half the radiator expense.

Did you write a bill of sale that both of you signed stating "as is no warranty"? If not, be ready to go to court if she takes it that far. You might offer to cover the cost of a new radiator if she'll pay to have it installed......that might satisfy her, new radiator is probably around $100-150.

She is SOL.

Unless she can prove that this is something you knew about and purposely kept from her, she has nothing. Even then, it is sold as is and the only thing on the line is your reputation.

And +1 on getting a cheap car with 100+ K miles and expecting everything to be perfect. I bought a few cars in my life and there were some bad surprises here and there after a week, big deal. If you want a car with warranty and everything, go to Carmax or buy new. Sucks but so is life.
