Under Texas law, drivers are required to either slow down or change lanes when approaching emergency vehicles stopped on the road, with emergency lights on. The law took effect in 2003. If a driver doesn't move over or slow down, they can face fines from $200 to $500. If there's an accident, of course they could also face criminal charges.
How many people do this? Not enough dammit.
This was an accident! They haven't (from checking last time) charged him with anything. He stayed there at the scene and took sobriety tests.

Yes, an accident caused by a totally inattentive driver messing with a cell phone, who hit a cop and a parked car on the shoulder of the road.

I just found out that this is a brother-in-law of a co-worker.

Extrememely sad, hitting close to home to a brother firefighter.

"If the guy was hit in a patrol car, he'd probably still be here alive and we would dismiss it as just another wreck. "

Cop was standing beside the stopped car and got clipped - having a car wouldn't have helped one bit.

Well, that's partially right. Most will use the car and park at a 45* angle to sheild themselves at a stop that has potential for an accident such as this. Being a motorcop, he didn't even have that option.

"Westpark is a controlled access roadway and when you come from Fort Bend County, for instance, it's eight miles to the next exit," he said. "We're not going to follow somebody for eight miles to the next exit."

There are some places that u are forced to do a traffic stop on the shoulder....

New info the guy that hit deputy norling admitted that he was talking on a cell phone and was swatting at a mosiquito and that caused him to drift off the road. Also breaking news the lawyer for this guy claimed that his client was rear ended about an hour b4 this accident and claims that his client might have blacked out when he swerved off the road. Also that the alignment might have been off from the accident earlier.

WFT?!?!?! It sounds like is a bunch of excuses to me and poor excuses at that. How does ur alignment get jacked up if ur hit from behind......maybe its possible but i really doubt ur vehicle is drivable afterwards. He also refused any medical attention during the 1st accident, claiming that he was alright and had no injuries. If he wasnt feeling good, light headed or even knew something wasnt right he should have been looked over......the woman that hit him was taken to the hospital in an ambulance. So i think they are just some bs excuses trying to cover his @ss.....

Typical defense lawyer BS. The one about the alignment is an old defense thats often used in DWI cases. Clients are told to state that they were swerving in their lane because of car alignment issues.

I have always thought that if you KILL someone in a motor vehicle and you didn't do it on purpose then you should have your license taken away forever. you ended a life because you were not paying attention to diving and the privilege should be taken from you. no need for jail he didn't intend to kill him but some long community service that his wife has to drive him too forever.
