what im trying to say is its safer for a bike to pass a car, then a car to pass a bike

It's safer for the Biker... not necessarily safer for the cager.
Problem is, the various murphy factor/influence that's being ignored.

Still doesn't really matter. Either one is initiating a risky and illegal action that the other may/may not be aware that effects both parties and unknown others.
