I don't think that they're checking for stolen bikes. I think they're checking for warrants.

They don't find stolen vehicles by snooping around on private property. I don't see how a parking lot is public property. I'm gonna look that up (just for grins).

i'm completely legit, and as long as i am i have every right in the world to be there. along with MANY other sportbikers who meet there and get harrassed.

We had a discussion about it a while back concerning putting a stunt show on in an ice house parking lot.

Basically, unless you can control all access to and from, it isn't considered private (so far as parking lots).

The business, like Starbucks, doesn't own the parking lot, unless they are a single business on a single lot. Mall lots are most definately public.

a parking lot becomes public when there is no reasonable expectation of privacy and is openly accessible. Last time I checked Starbucks does not post "no trespassing" signs and have their stored behind locked gates.

Same thing applies when I call out a K9 to sniff the outside of a vehicle when doing drug interdiction. Case law has decide that the air outside of a vehicle is "public" and a dog smelling the outside of your vehicle is not a non consent search. If the dog hits you have probable cause to do a non consent search of the vehicle.

Oh well. My stuff is all in order anyway so I'm not too worried. I think that I'm gonna get the helmet exemption sticker just for the 'ell of it.
