Thumbs down Tow Truck Damage

I got arrested for a few old traffic warrants from 01 last Thursday night.. woops! So anywho, my bike gets impounded. Monday I went to pick it up (290 bucks!) and found significant damage to the tail, mid and lower fairings. Looks like it might have feel off the truck or some such. Well the impound lot was giving me run around, basically saying I cant do anything and what ever else. They got the tow truck driver on the phone (I didn't speak with him) but they told me that he said "It was like that when I picked it up." Go fsck off basically. Now I don't mind little chips and nicks, thats expected, but this is more than a nick (see the pics). So to make a long story longer, I called HPD out to file a report before I took it away. I also took a ton of pics with a disposable camera while it was at the lot.
Has anybody had anything like this happen to them before? And can anybody recommend a good attorney? It will probably be cheaper for me to just fix it my self rather than have a lawyer go after them, but its the principal. I will spend 5 grand to fight them vs 500 bucks to just fix it my self.

Call the city and file a complaint against the tow campany with the wrecker inspectors. Also, get your origional arrest paperwork because the officer had to make an inspection before impounding it, if the damage is not on the sheet that he had the WRECKER DRIVER sign, the wrecker company and the city are liable for damages.

Ex- wrecker driver....

The subframes straight, the tail is just knocked out of place. I wonder if somebody tried to ride it at the impound lot and dropped it...

Not true, the officer had to fill out a tow report. This has the area where he HAS to write all damages on, and then the wrecker driver has to sign for it. The officer keeps a copy, the driver gets a copy, and Max should have got a copy. That is the law.

good to know, so the cop would be a witness. kinda weird but whenever i ran around w/ a towing friend of mine we never did one of those reports.

I have the arrest paper work. The officer wrote in minor all over. WTF is that about? Rock chips and nicks?
Do you have the number or some such for the wrecker complaint office?

man that sucks!!! i hate tow truck drivers! had bad experiences with them on few occasions already.

had my worse experience with them with a tow truck driver that operates around bw3 - rice village.

I HATE HEARING LIKE THIS!!! It makes me so fugging mad, I have lost count on how many fugging wreckers damage vehicles and get away with it time and time again!!!

4 ways to handle it IMO:


1) let the police do what ever they do and I am positive it won't be much for this.

2) petrol bomb the wreckers office. yeah sounds dead imature but seriously that's how gets taken care....well, er.... at least it feels good!

3) lawyer - loose loads of money to MAYBE prove a point (wish I had loads of money)

4) OR call the news station, local politicians. Make a story of it, maybe organize a campagne that we can all rally in outside the wreckers place of business!!! Then we can ride to mayors office and just cause havock with our free speech rights!!! I know I would join!!!

o and it is quite a long process to get the tow truck driver to pay for the damages. and not only that, it isn't guaranteed either.

Dont remember the number, call 311 and ask. Minor only means chips and nicks. That obvious of damage should not have been missed. Drivers are NOTORIOUS for riding bikes, dumping them, sliding them off the back of trucks and denying EVERYTHING.

It will be a lenghty process. Ask if the arresting officer will be willing to meet with you. Ask him if he would be a witness for you against the wrecker company. the storage lot also has to make a damage report on every vehicle BEFORE the wrecker driver drops it off. Hope this helps.

Did you see what kind of wrecker loaded the bike...i ask this cause all the damage looks like it was loaded by a sling truck, which will cause damage to anything it tows. if it was loaded by a wheel lift (or roll back) it wouldnt have damaged it unless it fell off (or coulda been knocked over at lot)

anyway as far as gettin anything solved (i.e. them payin for damages) you are basicly screwed. even if you got a good lawyer, got the lawyer fees put in with settlement and win you still gotta get them to pay.

It was a wheel lift. It looked as the guy loaded it well, but I'm no expert on towing so beats me. I seen enough to know that the damage did not occor while loading.

Not true, there are 3 seperate damage reports. Al of them cannot be same.
