Here's the Texas Law...

TRC 541.201.

VEHICLES.

In this subtitle:

* * * * *

(8) "Moped" means a motor-driven cycle that cannot attain a speed in one mile of more than 30 miles per hour and the engine of which:

(A) cannot produce more than two-brake horsepower; and

(B) if an internal combustion engine, has a piston displacement of 50 cubic centimeters or less and connects to a power drive system that does not require the operator to shift gears.

(9) "Motorcycle" means a motor vehicle, other than a tractor, that is equipped with a rider's saddle and designed to have when propelled not more than three wheels on the ground.

(10) "Motor-driven cycle" means a motorcycle equipped with a motor that has an engine piston displacement of 250 cubic centimeters or less.

Now if i were to street an NSR 50 or get an Ride Smart 50, would i need :

1) Insurance?
2) Proper Title?
3) Motorcycle License?

FYI - both bikes hit 55-60 mph, person in question does not have a motorcycle license, or insurance - getting it as a moped.

Now how would you guys interpret the law in this case?

motor-driven cycle to me fits the bill

i dont think moped caues of "that does not require the operator to shift gears."

Street legal meaning that it has to have lights ( front/brake), mirror, and documetation for registration, inspection.

The above description is only categorized as Moped. So, if you have anything bigger is not a moped but a motorcycle. The loophole is called motor vehicle. 50cc or less does not required driver license.

Gotta have tags. All motor vehicle on the street must be registered and inspected and insurance. Having a license or not is another matter. I think that you must be 16 to ride this thing on the street.

I thought riders of mopeds/motorcycles of less than 125cc are not required to have M endorsement.
