"Define safely or practical, as usual if an officer wants to generate revenue or otherwise harass you the law is written so that it is their call on what constitutes an infraction."

I don't have to, that's the domain of the cop, the prosecutor, the court and the jury if it goes that route/far.

One could suggest that the rider in this incident 'felt' or thought it was 'safe'..obviously he was wrong.

From a legal perspective, if he was going above the posted speed limit, he was unsafe regardless of what he felt. There are often times where we will break that number on our bikes and not die. But that's the threshold that is set for making the determination by cops and the courts.

My point is that you can be going well under the posted speed limit (as no one I'm aware filters or splits at the posted) and be changing lanes in a manner that clearly communicates your intentions to other drivers and minimizes the chance of a collision and a cop can still right you a ticket for being impractical or unsafe based on how he feels at that moment, without respect to whether your actions actually are impractical or unsafe.

I agree in part and disagree in part. Is that scenario possible? Yes. Is it probable? No. It's really hard to go under the speed limit on a motorcycle in Houston. It's too dangerous because everyone is going faster. Almost everyone understands this, and those that don't still speed regardless. The question though becomes how much faster becomes more dangerous.

The unfortunate thing about bike wrecks like this is that usually the rider isn't available for comment. If the rider doesn't make it, he can't comment. If the rider is alive, their working on getting him to a hospital so he can't comment. Which leaves the rider's story up to "witnesses" while the other party in the crash can tell their own story. The quote to which I was referring however had to do with filtering ( moving to the front of two lines of stopped vehicles at a stop light via temporary lane sharing between the two lines) and lane splitting passing between two or more lines of stopped or slow moving traffics by lane sharing between the two lanes. Both these activities are done when traffic is either stopped or nearly so speeding (traveling above the posted speed limit) is not a factor, but an officer can still judge you to be traveling too fast for conditions even at 1mph in a 50mph zone, if in his estimation the only "safe" speed is 0.

To my mind it is unsafe for a rider to remain hidden directly behind or in front of cagers. If they don't expect to see you the brain dismisses what their eyes see and says you aren't there and they will hit you. While in or nearly in between lines of traffic I am in the most visible place and already aligned with my escape route if trouble occurs. It is unsafe and impractical to ride a motorcycle without gear. It is also equally unsafe to risk a heat injury sitting in traffic in said gear while cagers enjoy their air conditioning during times we are unable to cool either ourselves or our bikes without the airflow created by at least a walking pace. To me, I'm willing to risk the ticket rather than my neck.
