Lein release

Has anybody ever petitioned for a Lein release before? Easy process? Pain in the ? I bought a 2007 r6 without a title. Good deal, couldn't pass it up. I had the state run the vin and they said there is a Lein on the bike from 2010. Got an email saying to petition the court for a Lein release. I was wondering if anybody has gone through this before. Any info will be appreciated.

I got the bike for next to nothing. It was a pile of parts when I got it. Fixed just about everything on it so far. Just waiting on a few more parts. If I absolutely cannot put it back on the street I'll track it out

Who is the lien holder? If it's a bank they're going to want their money and have every right to repossess the bike from you. You'll be out the bike and will have to prove that the seller misrepresented the bikes title status for you to have any chance of getting your money from him.

Probably not morally sound, but if it were me I would just leave the title status alone and put it on the track. When you sell it, be transparent with the purchaser.

I have no idea who the lein holder is or how much is owed. Waiting on that information currently. If it's a small amount couldn't I just pay it and have the title issued in my name?

I was told that after 10 years of the lien date it will fall off due 10 expiration.
I can't remember if the tx off told me that or the DMV.

But that at least a 1.5 year wait.

The Lein was apparently put on the bike in October 2010, so I got about 5 years to go for that one

seems like you and the seller both got a good deal, thats why you should never buy a bike under any circumstances without a title, not to mention its illegal to sell one in the state of texas as such.

Here's the corresponding statute:

Transportation Code Section 501.152 http://ftp.txdmv.gov/pub/txdot-info/...l_book_451.pdf


(a) Except as provided by this section, a person commits an offense if the
person:
(1) sells, offers to sell, or offers as security for an obligation a motor
vehicle registered in this state; and
(2) does not possess the title receipt or certificate of title for the vehicle.
(b) It is not a violation of this section for the beneficial owner of a vehicle to sell
or offer to sell a vehicle without having possession of the certificate of title
to the vehicle if the sole reason he or she does not have possession of the
certificate of title is that the title is in the possession of a lienholder who has
not complied with the terms of Section 501.115(a) of this code.
No person in this state may offer for sale any motor vehicle registered out of state
without having in his or her possession a title or registration receipt if the motor
vehicle is from a non title state.

Also the above poster who mentioned the 10+ year lien limit, may be correct about that, if the lien cannot be found... here is the supporting statute for that:

Sec. 501.116. CANCELLATION OF DISCHARGED LIEN. The department may cancel a discharged lien that has been recorded on a title for 10 years or more if the recorded lienholder:

(1) does not exist; or

(2) cannot be located for the owner to obtain a release of the lien.


What i would do if i was you is inquire about the lien, insist that the lienholder produce the lien and if he cannot produce it then you file an affadavit showing that and use it to register "your" bike.

OP i actually read the lien discharge statute a second time (and a bit closer) and noted that technically the lean cannot be discharged simply due to a 10 year expiration period, the lienholder must either not exist or must not be able to be contacted.

if your lien exists on the title and the lien holder is willing to lay claim and dispute then you cannot circumvent the lien.
