Boots damaged by 290 HWY Contractors, recourse???

So I was entering the 290 ramp between Antoine & 43rd westbound, and there was a crane moving rocks. Well somehow a big rock got over the barrier and gashed my boot pretty good.


So I hear how people get there rims replaced when they get dinged by potholes around town, so how do i see if I can get this covered?

After several good replies, on the closed thread, I am going to try to go through TXDOT.

This is relevant for us Street Riders in case anything like this happens (boots, Struts, Bent rims, etc.)

I will report the steps i go through to see if it can be done.

If i can do a Parade Lap at TWS (Texas World Speedway) when i see fit, I'm sure i can get TXDOT to cover it or it's contractors.

Lets try this again. Geesh.

There is no way you're gonna get compensated.

There is no proof that the damage on the boot came from a rock.
No proof it happened where you said it happened.
No proof it happened how you said it happened.
You got no witnesses.
You got no video.

You don't think they're gonna cut you a check just cuz you said, do you?

If you had wrecked and people saw what happened you'd probably have a case but...

Can you prove the was from where the crane was working?

It could have been a rock from anywhere. Rocks are all over the place.

Probably out of luck. Now if you would have stopped and gone back to talk with foreman (and got his name) you might be able to get company to replace boots. Could complain to county or city that it happened in. Technically this would be an incident report against them, bad news for next gov contract.

Of course there is no recourse but you would be surprised what you can get if you ask nicely. If one of my employees damaged someone's nice boots and they came to me in a respectful manner I would cut them a check.

If you can prove they're liable, legally they only have to pay you what the value of the boots were at the time they were damaged. Just as if you total a 10 year old car, insurance isn't going to buy you a brand new one to replace it.
