Niccolo Canepa Incident At Mugello: Track Rage, Or Unintentional?

Video of Niccolò Canepa causa un incidente al Mugello?

During an amateur practice session held on the Mugello circuit back in September 23, 2013, a track camera captured this incident involving Niccolò Canepa and Davide Cappato, in which it appears that Canepa reaches over and taps the brake lever of Cappato's bike, causing the fall. It was reported at the time that Canepa claimed the act was unintentional; however, Italian authorities have recently ruled otherwise, charging Canepa with a crime. Open and shut case?
