he should've been looking rather than whistling i saw the lady and her bright white jacket for several seconds before she even entered his area of the lane.

simply put, if you are lane splitting and you're thinking about just the cars/bikes around you...you're doing it wrong. You have to really take a look at the "Big picture" and realize that anything can happen at a moments notice so take a big, long, look left, right, up and down...and repeat.

EDIT: but one does have to mention that the lady is 70 and not 7, she should know that the area has a medium amount of traffic at that time of day and crossing at the crosswalk which was, what, maybe 100m left or right of her position would've been the smartest and safest bet for her. especially at her physical fitness and condition

I saw the old lady too, but the camera was on top of his helmet, not at his eye level. It's possible his view of her could have been obstructed by the cars.
