(B) to prevent the other who is fleeing
immediately after committing burglary, robbery, aggravated
robbery, or theft during the nighttime from escaping with the
property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or
recovered by any other means; or
(B) the use of force other than deadly force to
protect or recover the land or property would expose the actor or
another to a substantial risk of death or serious bodily injury.

Before anyone gets anymore dumb ideas just remember those are all reasonable defenses. They will not prevent you from being arrested, having to post bond, having to hire a lawyer, having to go to trial or having to pay court fees. They may keep you from being convicted, but not necessarrily from being charged and all the headache that goes with it.

That said smokem if you got'em.

I just read a deal that said an undercover cop is the one who got him to the ground and kept the angry mob from kicking his .

I ABSOLUTELY understand why they charge with uumv. My point was that if you get convicted of stealing the vehicle it is NOT the same as getting convicted of driving a stolen vehicle(that's it). I under stand that what ever you are charged with needs to be able to be PROVEN in court this is why the guy who took my truck was charged and convicted of uumv. I don't know if the felony charge for uumv is any different for a cheap bike or a Ferrari? But the feral who took my truck was placed on probation.

They're not going to parole a violent offender to make prison space for a car thief.

If Texas didn't have UUMV I could take a Ferrari with the intent to chop it and sell the parts. If I got pulled over in it before I chopped it I could tell the cop I was just out for a joy ride and planned on returning it. See how that works?

You're hung up on a term (words). Judges and prosecutors are not.

Sadly, I think I know this kid, well not so much him but his former neighbor. I played tournement softball with his neighbor for a few years. He would get him and bring around the ballpark, but you could never talk any sense to him. Can't say I didn't see this coming. What a complete an utter waste. Ruined life and and ruined bike.

Not quite sure what you mean by this. I personally hate the term African- American as American Blacks (which I proudly am) have about as close a tie to Africa as American Indians do to Russia. The majority of Black community is doing great, but then a guy holding down a career, taking care of his family, with a house in the burbs, paying his dues and his bills happens way too much to make the news. Crime is news the more sensational the better. The reality is young people of all ethnicities (there is only one race, human) make dumb decisions that affect not only their own lives but the lives of others. I know some people want to make this a racial issue (which it isn't) because they can hide behind their avatars, all gassed up on that keyboard courage, but I have learned over my years in the Army, thieves and cowards are usually the same person.

I was was there, the kid hot wired the bike.

The injuries were minor due to there being 2 off-duty officers in the parking lot were the kid was caught. At the scene the most he had was a nose
