Sucks about the bike, but really not a mark on the dudes face?? If the cops were at the scene immediately then I understand. If not then that "crew" is a bunch of lol.

I would have. Dude we be out of jail in no time and you have to use your insurance to fix your bike. It's probably totaled from the pictures. Sorry if I offended you non-violent types, but I have no tolerance for thieves. Only the scum of the earth steal what I worked hard earned money for.

Don't look like he got booked for theft of any kind. He was charged with unauthorized use with a measly 2000 bond. slap on the wrist. If he don't have a bunch of priors he won't serve any time. What a shame

Hey, no offense taken. I agree that a good whoopin is just the start of what those fools deserve. I just don't think that it's worth going to jail myself to give it to 'em. I don't think that makes me a , I just consider the cost vs reward of beating their . If you feel like it's worth it, more power to you.

I don't think it is as bad. Joyriding without permission with the intent to return is unauthorized use. That's what they charged the that stole my truck and he was caught driving it two hours after it was stollen. But the cops said the da would not be able to PROVE he was the guy who actually stole it. Go figure. I do think they are both felonies ( someone can correct me if I'm wrong) but the theft is far worse

What the ? So if someone steals your but can make a plausible case that they were going to bring it back eventually, they didn't actually steal it? Once again, the law appears to favor the criminals.

A LEO posted recently that Texas uses "unauthorized use of vehicle" because it covers all the bases and the penalty is just as severe whether you planned to keep the vehicle or not.

31.07. UNAUTHORIZED USE OF A VEHICLE. (a) A person
commits an offense if he intentionally or knowingly operates
another's boat, airplane, or motor-propelled vehicle without the
effective consent of the owner.
(b) An offense under this section is a state jail felony.

It's a felony

I would like to see what wakjum has to say about it being just as severe. I understand they are both felonies. But the guy that was caught in my truck DID NOT serve any time except till he posted bail. He was in jail for aprox. 18 hours. Had he been charged and convicted with actually stealing a 50,000 dollar truck his would have went to prison no?

You have to enter a guilty plea, reach a plea agreement, or go to trial before they can put you in prison. All but the most heinous crimes are eligible for bail until trial. I'm telling you the penalty is just as severe and it's always "unauthorized use". This is Texas and we don't play.

Go ask Wakjum and get back to us

Depends on his criminal record, representation, circumstances of the crime, etc....


The value of the MC would have been s state jail felony also, just as Bevo pointed out....(unless it was valued at 20K+)

Your truck would have been a 3rd deg felony if the DA felt they could articulate that the person caught operating the motor vehicle was the person who stole it.

So, has the guy in your case had his day in court yet?

State jail felony sucks......

Without a bunch of priors it will get dropped to a class A misdemeanor and he'll get probation. Not enough for stealing AND totaling your bike.

Show up in court and ask for restitution order
