To those that think it's a grey area for lane splitting in Texas, it's really not. You can call it a grey area all you want but unless the cop or judge just doesn't feel like dealing with it, it is illegal. Below is straight from the DPS.

Motorcycles are considered equally as cars regarding traffic laws, so the single lane, signal intention and other statutes in the Transportation Code could come in to play.

The main statute that makes "lane splitting" illegal is Transportation Code Section 545.060, entitled "Driving on Roadway Laned for Traffic."

An operator on a roadway divided into two or more clearly marked lanes for traffic:
shall drive as nearly practical entirely within a single lane; and


Granted this can be fought by a lawyer, but in the courts eyes, it's illegal. That means it's not LEGAL so they can pull you over for it every time and write you a ticket you have to go to court for. Where as legal would mean cops wouldn't even bat an eye.

the problem wasn't splitting the problem was he was going to fast for his riding skills. LEading up to the crash he wasn't even really splitting, he had the entire lane.

there were multiple problems....the first being he was splitting in between lanes while vehicular traffic was moving plenty fast.

I've been in California and that's not how it's supposed to be done (traffic moving no faster than 30, bike moving no more than 10 above that, etc.).

And I'll take that bet any day of the week. There's no way in the car driver is going to be held accountable for that.

You do get that he ran into the back of the car, right?

That's smart that you have an action camera for evidence. I'm getting one this Christmas because I've seen too many videos where they're useful. As for lane splitting, riding is risky already so I'm not taking chances with this city. There are too many malicious/sociopath drivers. Also I don't commute on my bike during rush hour so less road rage incidents.

So if you have a video of you driving in a manner that most judges will more than likely view as validating their already biased attitude that all bikers are jerks, and you run into a car - regardless of why the cager moved his car - and you're supposed to have your vehicle under control at all times including conditions for heavy traffic - - - - - - your video is supposed to get you off the hook?

Unless you got a good friend as a judge. And if you do - please share his/her name because I've been plenty harassed by red 'n blue myself for no reason.

Just trying to understand the mindset of the "I JUST GOTTA LANE SPLIT ON MY BIKE OR I'LL EVAPORATE". I don't see how an incriminating video of your driving will help. I really am interested - has anyone ever gotten a ruling in their favor from a video like this being presented as evidence?
