Yes same person. Been going on for a while. Since it's a lawsuit I'd rather not discuss it. It stems from the incident at TWS (Texas World Speedway) with extreme last year.

This is why I sold all my bikes. No real desire to ride when you're being sued.

Man, I hope things don't go in his favor. Otherwise, it'll set a bad precedent for future cases. It'll open the flood gates to these types of bogus lawsuits...

Hope the court dismisses the case as it should, for j_e_hurst and for all of us....

Sorry you have to go through this Josh....seems if the guy was so experienced, like the article claims, he would be able to avoid accidents easier....hope everything works out and you get the desire to ride again.

Sucks that someone can go into a situation knowing the dangers, and then sue when something happens....

Waiver

http://extrememotorsportstrackdays.com/legal.html
Quote:
Extreme Motorsports Track Days, its sponsors, its volunteers and corner workers and the track facility assume no responsibility for my safety while participating in any track day event. I voluntarily on my own assessment of my ability, the track, and track conditions, assume all responsibility and all risk. I release and hold Extreme Motorsports Track Days, its sponsors, its volunteers and corner workers and track facility harmless for any injury or loss to my person or property, which may result from my participation. I understand that this is a possibly dangerous and life risking activity and that I cannot hold Extreme Motorsports Track Days, its sponsors, its volunteers and corner workers and track facility or any other person responsible for injury or death resulting to myself or my property at any event.
Note that everyone at the track is waived from liability except any rider. Wouldn't surprise me if they started requiring liability insurance

From this experience I've learned that the waivers do not protect the riders. Insurance will not cover it because it's on a closed course track. Be careful out there folks.

They may have to start writing track day insurance policies

If there were to be a judgememt against me, my assets are protected. Everyone's are in Texas. Your personal property is exempt. My credit however would be ruined. If I were to ever sue someone in the future, that money would go towards this judgememt first before I received anything.

It says that you assume all risk and all responsibility. I'm not very good at lawyer speak but it seems to be that by saying that you can't blame anyone else but yourself.
