The reason Texas Police Officers don't assign fault on private property is that the Texas Traffic Code only applies to public roadways and certain private roadways that have special conditions that are met. That way people can do what they want with their property (e.g., parking lots, race tracks, etc.) and not have to worry about getting a speeding ticket or improper turn citation on their own property.

From the looks of the pic it is a parking spot that is off to the side of the main road so being that you were on the public road when he hit you, it's his fault. Insurance shouldn't fight you on that.

Now if you were in an actual parking lot, then it would be a different story.

anybody know where i can get the fairings with no paint??
should i invest my money on fixing everything out or just buy another one
for around 2,500?

Have a mechanic make an estimate on your bike. See if it is worth fixing it or getting a new one.

If you were going 25 in a 20, they will partially blame you for the accident even if they were reckless.

Some people do not report it to the insurance at all. They just fix the bike, then try to trade it to the dealer or buyer for something else. Just saying that that has happened.

Since it is a "park" parking lot, you need to see if it is a public/state park. If it is, then the police officer can point the finger. If it is a private park, then you are screwed.
