Need Help

Last Thursday I was hit by someone who ran a stop sign here in Katy. The driver was in a Enterprise Rental car but not listed as a driver. Her husband is the one who rented the car and let his wife drive it. Enterprise has told me they wont cover my damages cause the driver wasn't listed as a driver. I only have liability on my ins cause I dont owe a dime on her. How can I find out what the husband's Auto Ins company is? I need this info so I can file a claim against them..

Why not get a lawyer and sue them? They should do all the work no?

And their insurancr, not enterprise should pay the damage. I had a rental, my insurance covered me even though I declined the enterprise insurance

This^^ Police report? like said above get a lawyer and let them do the work if theres a police report and shes at fault would take some time but should be in your favor.

The first question I would have how much damage do you have? If there is ANY bodily damage involved DO NOT SETTLE AND GET A LAWYER, you will be glad you did afterwards. If there is just a minor scratch on your bike and the damage is below $5000 Here is how to handle that:

-) Get it repaired, yes that needs to be on your dime
-) Make sure you have a picture of the damage
-) Make sure you have a detailed invoice specifying exactly what was done
-) Send Enterprise as the owner of the car AND the driver a demand letter to pay up with a reasonable, but short time of about 2 weeks.
-) After two weeks of no payment do not talk or argue any more, but walk straight to the nearest small claims court and file suit. When you file suit include the small claims filing fees into your suit. If you are an hourly worker and are missing work because of that get a letter to that regard from your employer and include that into the suit Up to the max of whatever small claims court allows, which I believe in TX is now $550/ but check that with the clerk. Ask for the paperwork to be delivered by the sheriff, otherwise you have to deliver it yourself.

And then wait and see them squirm. There is no defense for that and they will pay up.

Get a lawyer and fight them. I know someone going through the same situation. He got hit by someone in a rental car that didn't even belong to them. He's been fighting it for months and still doesn't like good neither insurance company wants to pay. Has over $10,000 damage to his bike and 90,000 in medical bills.

Update... I have hired a lawyer. His words to me were that this type of case comes around once very ten years.Reason being the driver of the car that hit me was a Mexican National and in the States on a visa. Second she wasn't on the rental agreement. Third how can you file suit against someone who may just leave this country anyway. The only hope I have is with Enterprise and prayer they cover this.

Forgive me if I'm wrong in saying this but why does the US Taxpayer always get screwed and others come and go out of this amazing country so easily. The driver of the other car got two tickets the day of the crash but what is stopping her from paying them and just heading back to Mexico. This whole thing makes me sick!
