Yes, as long as he had coverage at the time of the accident, they are liable. I'm still in the middle of my PI settlement from my accident in May when the guy ran and the adjuster was telling me about drunk drivers and coverage. Although the guy that hit me wasn't caught until a few days after, she felt it necessary to tell me about drunk drivers and coverage in some small talk we had. That's the entire reason premiums are higher for drivers who have priors.

the car was actually a rental car and the guy is from louisiana visiting, im currently dealing with the rental company now.. but still have ALL of this guys info

me riding 2am because i was coming from a club with my buddys

You were probably the only sober person in the entire city at that time of night. I have never been out and about at 2am sober in my entire life.

I've jumped out of the way twice. Once it was a non-event and the driver stopped plenty far back. The other time I saw one coming fast so I shot up between 2 cars in front of me. one thought though is being out on a bike at 2am isn't a good idea. Especially in the city. Bars (are supposed to) close at 2am so the number of accidents go up after closing time. I'm sure you learned several lessons but dont miss the obvious one. stay safe by keeping yourself out of danger.

glad you're ok man, and like others have said make sure you get your fixed.


also a good statistic to keep in mind that after 10pm 20% of drivers on the road are drunk so at a red light of 10+ cars at LEAST two are drunk, never forget that.
