"Ruling after a non-jury trial requested by Telban, County Court Judge John J. Connell said he found insufficient evidence that Telban was guilty of a felony charge of second-degree vehicular manslaughter. The judge, however, convicted him of a misdemeanor of driving while intoxicated.

Under New York law, the judge said, intoxication alone was not enough to convict Telban of vehicular manslaughter. The prosecution had to prove that Volkmuth’s death was a direct cause of Telban’s intoxication, but failed to do so, Connell said."

he hit a biker, killing him. how is that not proof enough? if it were any ordinary civilian he would of been convicted with vehicular manslaughter. i just think its ridiculous. he should be treating the same way as anyone else. he ****ed up and he should pay.

So they could'nt prove that the guy being drunk contributed to the bikers death but they could prove that the biker was speeding? Hmmm. Ok.

I'm sorry, I was asleep in a filing cabinet in the time that court case. The Judge was actually an hobo I hired to fill in for me.


BTW, I READ the article, precisely where does it state that he HIT the bike/rider?
"Volkmuth, 27, of Greece, was killed when his motorcycle, which he was riding west on West Ridge Road, collided with Telban’s pickup truck as Telban pulled out of Braemar Country Club, 4704 W. Ridge Road."
