Man, that sucks. My neighbors boy is locked up for killing a mom and her 2 kids while street racing. Pretty sure the kid he was racing with was also found guilty on 3 counts of manslaughter. I think they're both looking at facing 20 years locked up, one would think the sentence for this guy will be much less since no one outside of the participants were hurt or killed.

2003 Buell?!?!? That would be like an Xb9 or a gulp.... Blast. This immediately calls into the question the witness report that they went by at a "high" rate of speed. The XB9R's top out at like 140 and they need some room to get there. The Blast might roll off a cliff and hit 90. I find that eye witness always seem to say we are going A LOT faster than we actually were when these things happen. Even the standard computations LEO use to investigate wrecks use the standard formulas for the friction and inertia of cars when rebuilding accident scenes. Bikes present much less friction and slide much further much easier which often gives the suggestion that our accidents happend at higher speeds. The fact that we sustain greater injuires at lower speeds, and the fact that occassionally their is a an idioit who does crash somewhere north of MACH 1 doesn't help.

Still sad either way.

Looks like it changed the punishment so that the range is from a Class B misdemeanor up to a second degree felony

People automatically equate loud with fast. People see two riders aggressively enjoying a route and assume they are racing. Who knows if they were in fact racing? How many our our rides would be viewed as racing by someone we have passed? My guess is most "spirited" rides would be called races my most.

I see no problem with the way the law is written. The 2nd guy that survived was NOT charged for the 1st guy's death.

He was charged in engaging in hazardous activity.

The degree of felony charged is determined by the degree of hazardous activity.

The degree of hazardous activity is determined by whether a death or serious bodily injury resulted.

These two are alleged accomplices in the same felony. If they had killed an innocent pedestrian, it would trigger the same upgrade to 2nd degree felony. Same also, if they killed a pillion rider. Would it matter which bike the pillion was on? Or which bike struck the pedestrian? Or which of the two idiots died?
