Exactly what patrick said, do not threaten lawyers. You should get between $4-5k I would think. You do not have to accept a lowball offer. If they total the bike buy it back and fix it cheap.

Property, personal injury ;- > hes great at what he does. You might see a commercial in the near future where a guy was rear ended in a drive through and got 250k ;-)

Yes.
Typically if the repairs equal or exceed 70% of the value of the bike it will be totaled.
