Also, note the time and date that the bike was dropped. Take plenty of pictures of the damage for court. If the repairs are more than the bike was worth in good condition, you'll just get the fair market value of the bike, so find out what that is as well.

I did exactly that when I test rode an '86 XJ700 yrs ago. I promised the owner I'd buy it, and I went back with a Uhaul box van and a cashier's check a week later. Ended up making a project of it - overhauled the engine and repainted it candy apple red. Great learning experience for me on many levels.

I'd say work with the guy. I'm not particularly religious, but I do believe what you do onto others will eventually be done to you - many times over. That theory has been tested numerous times so far and has never failed me yet.

Stay on the up and up and hold your head high, no matter the outcome.

you need to insist that he just bought your bike. if you agreed on it, and have something in writing then you need to write down all the events as they happened in a formal letter into an affidavit of fact, get it notarized and go down to the civil court house and make a small claim against him, other than that you may not have much recourse.

I have ridden every bike I have purchased. But I have either had cash in hand for the purchase ( finance for the newer ones ) or trade/collateral for the bike present and in control of the current bike owner.

When selling I have allowed rides if cash in hand,~70% to 100% cash in hand depending. If cash was not in hand and seller wanted it, we would meet up again on the sell date when they had cash, and they would ride it then.

To date this has worked with 100% no issues to those who were serious about buying the bikes..

I think you can win in small claims court, but that does not really get you your money... a judgement is not payment.
There are some guys on here that I would trust and they can ride my stuff buying or not, but a co-worker of a friend is nobody. If you do anything to him, then you are out twice.

sucks man sorry for your loss. just gonna have to accept the loss. live and learn. cash in hand always. I just sold my z71 with a 16" lift and made him give me cash before test driving it.
